Penal Code section 27535 says:(a)A person shall not make an application to purchase more than one handgun or semiautomatic centerfire rifle within any 30-day period. This subdivision does not authorize a person to make an application to purchase both a handgun and semiautomatic centerfire rifle within the same 30-day period.
(b) Subdivision (a) does not apply to any of the following:
(8) Any transaction conducted through a licensed firearms dealer pursuant to Chapter 5 (commencing with Section 28050).
Penal Code section 16190 defines "application to purchase" as when a Dealer Record of Sale (DROS) is electronically transmitted to the Department of Justice.
So in other words you can do a DROS on a handgun or a semiautomatic centerfire rifle once every 30 days. There are no time limits on other firearms, such as shotguns. Also, there are no time limits on Private Party Transfers, in which you're actually purchasing from a non-dealer, though the dealer is holding onto it for the 10-day waiting period. A Private Party Transfer is a transaction defined by Penal Code section 28050. And so Private Party Transfers under Penal Code section 28050 are not subject to the once-per-30 day limit.
So buying a shotgun and buying a handgun from a brother doesn't trigger any time limits.Last edited by ????? ????; 08-24-2021, 8:09 PM. -

Also, the purchase from your brother is exempt from 1/30 if you are both meeting at the same FFL to do the transfer. PPT is still exempt.Comment
