    Questions: What docs does an FFL need to keep after purchase

    I tried to search the forum but was not able to find the info I was looking for. My question is simple: After I successfully complete a handgun sale what document am I required to keep. I keep a copy of all the docs now. Is that required or do I just need to keep the DROS and 4473? Thanks for any comments. Robert

    I'm curious to hear what other more experienced FFLs have to say on this.

    I've only had one DOJ inspection so I have limited experience on what they want to see. In my inspection they wanted:
    • DROS initial and approved
    • FSC or proof of exemption (I don't recall if they asked to see my FSC tests and issued FSCs)
    • Gunsafe Affidavit or proof of a gunlock
    • Safe Handling Affidavit (or proof of exemption)
    • Copies of any denied or cancelled DROS


    What they didn't specifically ask for but I had included in my paperwork were:
    • ID
    • Proof of residence (if a handgun)
    • C&R + COE if released immediately
    • Firearms Shipment Approval letter or number
    • 4473


    I assume they would have asked for most or all of these but can't be sure. This may be more than required and I know there are members here who advise only giving what is required by law. I get that, but I think I have a great relationship with my Field Rep so if she asks for it I'll give it to her.

    However, I'm a small operation so I don't have to deal the the volumes of paperwork a brick and mortar store has.

      Not knowing what YOU mean by "document" and given that your transactions are subject to audit by DOJ and ATF, I suggest that you retain everything as it is all auditable. Both agencies want to insure that you are complying with the law and procedures set forth by each agency.
      Also, DOJ requires that you retain the DORS documents for 3 years after the transaction.
      Once the transaction has been completed, separate the DROS doc's from the 4473 and file separately.

      Perhaps someone else will post the pertinent legal sections.

        FS Tests and card copies should be retained of 5 years as that is how long they are good for.

          We retain the following

          For 3 years: All documents related to the DROS process, including IDs, FSC, Proof of Residency, Safety Demos, Safe Affidavits, Pending and Approved DROS. Any other documents required by CA such as Green cards, passport photos.

          For 20 Years, or for eternity: All federal documents such as 4473, multiple handgun or rifles forms.

          For as long as I want to keep them; Our Aces Jewelry & Loan customer agreement page. This helps with credit card chargebacks, and a CYA just in case a buyer does something stupid with a gun and blames us. Its our "I told ya so" proof.
