    Non-California FFL Holder Ammo Law Question

    If you have a non-California FFL, are you exempt from ammunition purchase restrictions?
    I'm confused by this section:

    30312.

    c) Subdivisions (a) and (b) shall not apply to the sale, delivery, or transfer of ammunition to any of the following:

    5) A person whose licensed premises are outside this state and who is licensed as a dealer or collector of firearms pursuant to Chapter 44 (commencing with Section 921) of Title 18 of the United States Code and the regulations issued pursuant thereto.

        Not sure if you would need a 03 for CA but you’d also need a COE (CA only) as well in addition to the FFL03. Correct me if I’m wrong as I know this is that case for CA residents.

          No mention of COE or FFL holder's residence in section 30321 c) 5).
          As I read the statute, a California licensed premises needs a COE, but a non-California premises doesn't.
          Anyone here know the correct answer?

            You can't use that to ship to CA. Plus, Your FFL is location specific.

              Read PC 30312(c)(6), and you need a COE. The 03FFL has to be shipped to the address on the FFL. You can get a FFL for California while maintaining your current other state FFL.

                I'm talking about the ammo law exemption, not buying a gun. See the quoted statute. 6) specifically says California premises FFL. 5) is a separate exemption.

                6) A person who is licensed as a collector of firearms pursuant to Chapter 44 (commencing with Section 921) of Title 18 of the United States Code and the regulations issued pursuant thereto, whose licensed premises are within this state, and who has a current certificate of eligibility issued by the Department of Justice pursuant to Section 26710.

                    A non-resident of CA with a valid C&R 03-FFL is exempt from CA ammunition laws when acquiring ammunition in CA from a non-CA ammo vendor or non-CA FFL dealer. [PC 30312(c)(5)]

                    A person with a valid C&R 03-FFL is not exempt from CA ammunition laws when acquiring ammunition in CA from a CA ammo vendor or CA FFL dealer. [PC 30352 and 11 CCR 4306]
