    G43 PPT with father in law

    Hey Fellas,

    I can’t seem to get a definitive answer on this using the search function, so I thought I’d take a shot at asking the experts:

    My father in law, who’s a CA resident, took care of his sister in Phoenix for about 6 months in 2017. While there he purchased a G43, which he’s interested in giving to me. If he does, I’d like to add it my CCW roster but I’m not sure what needs to take place to get it in my name. Since it was purchased in AZ there isn’t a name associated with the serial number. Can we simply show up at an FFL and do a PPT to me? It it’s too much of a headache I’ll just pass.

    Couple Questions
    1) How did you father-in-law (who's a CA resident) purchase a firearm in Arizona? (dual resident? recently a CA resident, was previously an AZ resident? cash using no FFL between him as a CA resident and an AZ resident?)
    2) What do you mean "he's given" it to you? Is it in your possession?

    Some things to keep in mind before answering my questions.

    1) If he was a CA resident at the time of purchase in Arizona then that transaction is all bad and not legal.
    2) If he was a dual AZ/CA resident at time of purchase in Arizona then he was supposed to use an FFL in CA to transfer it to him as a CA resident, which for a G43 is not possible unless he is otherwise exempt
    3) If the firearm is in your possession then you will either by documenting an illegal federal transfer or at some point breaking the "loaning" laws in place in CA
    4) If he was an AZ resident at the time of purchase, moved to CA as a new CA resident then you might be ok with the exception of #3 above depending on who currently possesses the firearm and for how long.

    So.... can you get away with doing a PPT at an FFL? Probably.
    Have there been federal and state laws broken based on what you've said in the 1st post? Probably.

    So either don't respond to my post or if you're confident what was done was all to the letter of the federal and various state laws then your PPT at an FFL should be fine.

    I personally would not attempt to put a firearm on a CCW that may have questionable origins and may also put into question your good moral character.

      In any case, first explore how your dad came to acquire the G43 before you take ownership of it.
