    Deliver On Undetermined

    It looks like I may have my first DROS come back as Undetermined. I know the buyer personally and plan to go ahead and deliver the firearm. I have a couple of questions.

    He has a completed DROS for a shotgun from a few years back. I can't imagine he's had a felony or RO since then. He has a rather unique name so its not like they can't figure out which John Smith he is. The firearm I'm selling him is new so its not like it could be stolen. I can't figure out what the hang-up is. Any thoughts?

    Second, even if I delivery the firearm, he can't buy ammunition for it as best I can tell. Is there a process he can use to find out what the hang-up was and clear it up?

    Have him go get a livescan done. the form is on the DOJ website

      I delivered one on undetermined and they had no problem buying ammo.

        When delivering you can add ammo no problem to undertermined DROS's

        It's been brought up before that if you are not planning on delivering on undetermined you should have a disclaimer the customer signs at the beginning of the DROS to cover your liability.

        Never understood why other dealers would be concerned about delivering on undetermined. This state 27 more days than most states do to determine if someone is prohibited or not. When I sold guns in TX NICS can only delay for 3 days. If they don't issue a denial or approval you deliver to the customer.

        CA already crappy enough to have dealers scared to deliver to legal gun owners.

        I have like 4 customers who go undetermined everytime so they can't shop at stores that won't deliver.

          I had plenty of undetermined DROS' We had a policy to release on undetermined. As stated above it is good business practice to post a policy stating one way or the other. In todays society it is very easy for someone to say you recriminated against them and would not release their firearm.

            That makes sense, but what about an independent ammo purchase? I have only done the Standard check and I've never had one that wasn't approved so I probably don't understand the full process.

            Once I release the firearm on Undetermined that becomes the permanent DROS record that allows him to do the Standard Background check in the future?

              Did you mean "discriminated" against them....?

                Since they now have an AFS record if should be an instant $1 check.

                      DO NOT RELY on the justice system to to not make mistakes. You could very will still show a conviction in the system. Contact the court and make sure it gets resolved.

                        You should however get your CA criminal history report and your FBI rap sheet. You owe it to yourself to make sure they are correct and updated with the final disposition of the case.

                        You can dispute any inaccuracies or incompleteness on the reports. You want both your state and federal records to be accurate and leave no doubt that you are not prohibited.

                        Access to criminal history summary records maintained by the DOJ is restricted by law to legitimate law enforcement purposes and authorized applicant agencies. However, individuals have the right to request a copy of their own criminal history record from the Department to review for accuracy and completeness. Requests from third parties are not authorized and will not be processed. Note: Criminal history records requested for an individual’s own review cannot be used for Visa/Immigration or any foreign nation transactions.




                        Also be sure you have good court records showing the disposition of the case. You want to always have copies of those stored away safely, preferably exemplified/certified copies from the court clerk.

                          The 30 days is up tomorrow on my first delay and I also plan to deliver. Will the button show up at the "Latest Delivery Date/Time" posted to allow me to deliver the gun?

                            yes and you will be given a new 30 day window. Additionally, it may take up to 48 hours from after day 30. It used to be almost immediate, but during these covid times I've seen a couple be delayed between a few and 48 hours.
