FFL With Second Hand License and Off Roster?

    FFL With Second Hand License and Off Roster?

    Heres the scenario I'd like to know how to complete;

    FFL buys off roster pistol, used from a private party. Can the FFL then sell the used off roster pistol to someone else? EBR Works has been helping me with a lot of my questions and he stated the way to do this was "consignment ppt".

    Please elaborate on buying and selling used off roster guns as an FFL w/second hand dealer license.

    Once you buy it, it loses its ppt status and becomes a dealer sale. It needs to be a consignment for it to remain ppt.

        Ok once I buy it as an FFL can I resell off roster guns that are used and not new? Does the roster still apply to used guns?

          No, the FFL doesn’t Buy it. It must be consigned. If the FFL buys it outright, he could only sell it to exempt from roster individuals

            If the FFL buys it, then the Roster applies and it can only be sold to exempt persons (LEOs, etc).

            Does not matter if the handgun is new or used. The Roster applies to both.

              I found out the hard way "consignment" only shows up if you have a second hand dealer license and the firearms branch of DOJ has a copy. Otherwise the "consignment" option isn't available within the acquisition screen. If you go ahead and submit as an acquisition (and not a consignment) it becomes part of your inventory and is no long PPT eligible.

              Also, you don't need a second hand dealers license to buy and sell used firearms, only to consign them.

                On off roster revolver, dealer can buy, take sear off turn into SA, then resell. Many does this.

                    How would you explain it during an audit. Usually when money is exchanged ownership is exchanged.
