    Rossi circuit Judge 45lc 410

    Need FFL advice please.
    Is this something I can order and ship to ffl in California? Legal?
    Anyone who can help me order one in the bay area?

      18 inch barrel from what I am reading. Its the rifle version not the revolver

          Would this Shotgun fall under SB23?

          "any shotgun with a revolving cylinder"

          12276.1 (a) Notwithstanding Section 12276, "assault weapon" shall also mean any of the following:
          A semiautomatic, centerfire rifle that has the capacity to accept a detachable magazine and any one of the following:
          A pistol grip that protrudes conspicuously beneath the action of the weapon.
          A thumbhole stock.
          A folding or telescoping stock.
          A grenade launcher or flare launcher.
          A flash suppressor.
          A forward pistol grip.
          A semiautomatic, centerfire rifle that has a fixed magazine with the capacity to accept more than 10 rounds.
          A semiautomatic, centerfire rifle that has an overall length of less than 30 inches.
          A semiautomatic pistol that has the capacity to accept a detachable magazine and any one of the following:
          A threaded barrel, capable of accepting a flash suppressor, forward handgrip, or silencer.
          (B) A second handgrip.
          A shroud that is attached to, or partially or completely encircles, the barrel that allows the bearer to fire the weapon without burning his or her hand, except a slide that encloses the barrel.
          The capacity to accept a detachable magazine at some location outside of the pistol grip.
          A semiautomatic pistol with a fixed magazine that has the capacity to accept more than 10 rounds.
          A semiautomatic shotgun that has both of the following:
          A folding or telescoping stock.
          A pistol grip that protrudes conspicuously beneath the action of the weapon, thumbhole stock, or vertical handgrip.
          A semiautomatic shotgun that has the ability to accept a detachable magazine.
          Any shotgun with a revolving cylinder.
          "Assault weapon" does not include any antique firearm.
          The following definitions shall apply under this section:
          "Magazine" shall mean any ammunition feeding device.
          "Capacity to accept more than 10 rounds" shall mean capable of accommodating more than 10 rounds, but shall not be construed to include a feeding device that has been permanently altered so that it cannot accommodate more than 10 rounds.
          "Antique firearm" means any firearm manufactured prior to January 1, 1899.
          This section shall become operative January 1, 2000.
          Anyone submitting a comment regarding a proposed action has the right to request a copy of the final statement of reasons

            The current definition of assault weapon is in Penal Code section 30515, which does make shotguns with revolving cylinder "assault weapons".

            California Code of Regulations, title 11, section 5471, subdivision (ii) says:
            But all of that depends on something being a "shotgun" in the first place.

            Penal Code section 17190 defines "shotgun" as "a weapon designed or redesigned, made or remade, and intended to be fired from the shoulder and designed or redesigned and made or remade to use the energy of the explosive in a fixed shotgun shell to fire through a smooth bore either a number of projectiles (ball shot) or a single projectile for each pull of the trigger."

            The .45LC/.410 Rossi Circuit Judge has a rifled 18.5-inches long barrel. Since it has a rifled barrel and not a smoothbore, it's not a shotgun.

            But be warned that in California, a short-barreled shotgun can have a rifled barrel. So Taurus Judges are short-barreled shotguns.

              Confused AF now, so its sold as a rifle not a shotgun by description, but can be considered a short barrel shotgun with a rifle barrel, hence be questioned for legality? Guess the question is whether I want to be the test case or not?

                            Yes, 100 percent legal, but very hard to find for some reason. Last one I saw was maybe a year ago in a local shop in the high desert.
