    FFL03/COE Exempt from 1 in 30 Handguns, correct?

    Something came up today at one of my FFLs. I am set to pickup a pistol this Friday. Today DOJ called them and said my 30 day background check for my last handgun purchase has not expired yet.

    But I have an FFL03/COE. Does that exempt me?

    They had to cancel my DROS and needed to know what the date is from my last DROS of a Dealer Handgun. The last dealer sale (non-PPT) I had was for a C&R pistol on Aug. 4th.

    Doesn't make any sense why DOJ would kick it back since that should also be exempt...

    How do I clear this up? And will I have to pay for DROS ($137) all over again?

    Yes, C&R and COE allows you to purchase more than one handgun in 30 days, regardless of whether they are curios or relics. The FFL might have to educate the DoJ rep. On more than one occasion I had to sit there while the FFL called the DoJ and told them to read their own memo on it.

      Are you sure your FFL checked the 30-day Exemption box and entered your COE on your DROS submittals? If he did not you may have to re-DROS when the 30 days are up. Maybe your FFL can clear that up with a phone call...

      I hope your $137 for DROS was a typo. $37.19 for DROS.

        I am checking now, I hope they did but even if not, the last dealer sale I did was Aug 4th (for a C&R), and I ran this one on Sept 5th. That's 31 days after...

        Can a DoJ rep clear this up?

        And yes, $137. $100 transfer fee, and $37 DROS.

          They didn't check the exemption box.....

            Lord $100? Wow. I'm late to the party, but there is a bulletin in DES that tells them how to do it, that they were supposed to read.

              I don't know if the DOJ Rep can clear it or not. There is no harm in your FFL asking, especially if he neglected to check the box. I have been able to get the DOJ DROS hotline rep to deliver a C&R without the 10 day wait when I didn't run it correctly. But that is a different issue.

              If it were me, and it had to be re-DROSed, I would not charge you if it was my mistake. But you can't assume the FFL knows about the 30-day exemption, or that its important for you to not be held to it. Not all FFLs are up to date on the C&R/COE rules. Hopefully you told him to run the DROS as 30-day exempt.

              Even it was your fault seems like he could rerun it and just charge the $37.19, but that is his call and not an obligation.

                Its should have been dros'd as a C&R transaction, per the DOJ bulletin. No need to check a 30 day exempt box. The dealer just has to hold it for the 10 days since it will give them the option to deliver immediately.

                      Regardless if the 2nd pistol was run as 1-in-30 exempt it shouldn't have been rejected. The 1st pistol in this thread the OP used his FFL03/COE to pick up same day (no 10 day wait and no impact on 1-in-30 since that is automatically exempt).

                      The 2nd pistol run 31 days should not have been rejected even if the shop didn't run it as 1-in-30 exempt. Honestly, even if they did, it could have been rejected falsely..

                      I had a customer who did an interstate intrafamilial transfer a few months back... DOJ rejected 1 of multiple in the transaction due to 1-in-30 violation and I had the 1-30 exempt box checked. They said "You didn't run it correctly". I sent screenshots. They said "oops, let me refer this to a supervisor", never heard back. I ended up re-DROSing for that customer and went through next time no issues. Never did get a refund of $37.19 for DOJ acknowledging they effed up either.

                        Yes, that's how we were told to run them. DOJ has a bulletin with screenshots that shows how to do it. The reason for the C&R run is it allows the input of your COE. Doesn't make any sense, but don't try to make sense of DOJ or how they develop their apps.

                            When you did the DROS and did the preview did you check to be sure the 1 in 30 exemption box was checked?

                              Had this happen to me at Turners. (Yes, I know. Turners)

                              I explained to three different people that 03/COE are exempt and how to process. They looked at me as if I were crazy.
