Gunbroker problems/advice

Got response today from gunbroker. They say they can't force seller to sell. I am not liable for fees since I say I didn't break any laws.
I also looked at the claim against me and it is still there. It now says "credit issued". So to me it sounds like they sided with seller and let him get away with it. Also it no longer gives me a chance to respond to the claim. I don't like that it still shows "illegal to own". Like a stain on my record.
I responded to gunbroker asking to have the claim removed, so now I wait, again.Leave a comment:

agreed 100% and we are dealing with a pump action with legal dimensions in this case. Thank you all for listening to my long windedness. I will update as this progresses.OP let us know what happens. This is all the seller's fault. You gave him THREE legal ways to get the gun to you and he refused them all.
1) Private ship to your CA FFL
2) Ship to your CA FFL from an FFL of his choice who will use CA CFLC
3) Ship to middleman FFL in another state, either privately or from FFL of his choice
You also checked with him before bidding.
There is nothing illegal in CA about a pump or semi auto shotgun with a pistol grip (unless semi auto has a magazine or folding/collapsing stock)Leave a comment:

I attempted to file a claim, but could not reasonable state that he committed fraud. That was the only claim for i could find. He did refund me my money, so I'm not out money.
I did state in my dispute that I am not giving up rights to my property. In his ad he stated clearly that "once won it is yours". I also mentioned that he broke the contract, not me. I stated that I would seek restitution if I was impacted financially or socially by his breach of contract. I should have added legally, but I felt that legally was encompassed by the first two.
Mostly I just want this to go away. But so far it has not.Leave a comment:

I think your right, and his ffl stepped in and said this is how we make him pay for it too. Since he is in California we can double screw him.
And for reference I won it for $1000 +shipping. I didn't get it ridiculously cheap. MSRP is in the $1050+/- range.Last edited by pythonfan; 08-19-2020, 10:46 AM.Leave a comment:

Day 7 since I contacted GB for help. Not a peep from them. Day 8 since I disputed his claim that I committed an illegal activity. Claim still exists on my account and no word from GB. I've sent 2 replies to GB.
The firearm has now sold to someone else or was pulled by GB....I'm not sure, but it is no longer up. I'm in limbo.
I keep overthinking it....like caldoj is gonna knock on my door and inquire as to why I attempted illegal activity. I know better, but it still is in the back of my head.Last edited by pythonfan; 08-19-2020, 10:08 AM.Leave a comment:

I have a suspicion that after he sold it to you someone told him he sold it too cheaply and that he should cancel the sale.Leave a comment:

We can still log it in..we're supposed to use the return address on the shipping label in these instances.., but yes it does make us crabby to show the firearm came from "UPS Store"...or some other such nonsense...it is what it is though..Leave a comment:

Yes, driver's license. The receiving FFL needs proof of who they are receiving the firearm from. Of you don't include it, you make the FFL unhappy because they can't log in the firearm, and the buyer is unhappy because he can't transfer the firearm.Leave a comment:

Just thinking about doing this myself, so thanks for this thread pythonfan which shows some of the pitfalls awaiting me LOL!His big problem is sending his DL if he ships and his ffl doing the CFLC program. They don't want any of their info given to California. Which I understand. I didn't fault him and agreed to him backing out. I am understanding.
The problem is him reporting me as attempting illegal activity and demanding i pay his fees. I'm not sure if he legitimately thinks my option to have him mail directly to my ffl was illegal. Or if he is using this to worm his way out of paying the listing fees. Also he possibly didn't like the price I won it at so he wanted to try again and give me the blame for it.
Really I want to know that I didn't run afoul of any California or federal laws in my 3 options. I want to cover myself in case gunbroker doesn't know the law.
Option 1- he mails directly to my ffl. He includes DL and Bill of sale so I can pay my ca tax.
Option 2-he utilizes his ffl. His ffl utilizes CFLC program to obtain CFD 5 digit number and then ships to my ffl.
Option 3-he utilizes his ffl to log in gun, ship it to ffl in Nevada on my behalf, Nevada ffl logs it in, charges me a second transfer fee, obtains CFD number and mails it to my ffl.
Any California laws being broken? Any federal laws being broken? I just don't want to find out I did in fact suggest illegal activity. I don't think I did.
I understand options 2 and 3 for the most part, but regarding option 1...
...what is the "DL" you're referring to, "Driver's License", or...???
Thanks again!Leave a comment:

?Out of state from private Shipping to FFL doesn't need the shipment approval .
I think.Leave a comment:
