    Military orders question

    Hello all. I wonder if anyone here can give some insight on my situation. Last year I was on TCS orders OCONUS. I was injured and am now in WA State getting care. My oders state: "you are retained on active duty in MRP status". I'm sure it's unlikely since my orders do not state PCS, however, any chance I am considered a resident of WA while on MRP orders for purposes of purchasing a firearm? Thanks in advance.

    It's probably not gonna work. Under 18 USC 921(b), your federal "State of Residency" is determined by the location of your "Permanent Duty Station."

    Here's how the military defines MRP status (with the pertinent part in bold font):

    "The Medical Retention Processing (MRP2) program is designed to voluntarily return RC Soldiers back to temporary Active Duty in order to evaluate or treat unresolved mobilization connected medical conditions or injuries that were either not identified or did not reach optimal medical benefit prior to their Release From Active Duty (REFRAD). To be eligible for MRP2, a Soldiers medical conditions or injuries must have occurred while mobilized under 10 USC 12301 (d) and 12302 partial mobilization orders for operations in support of Overseas Contingency Operation (OCO)."

    So to win the argument, you gotta show that your temporary orders are permanent.
    If you build a man a fire, you'll keep him warm for the evening. If you set a man on fire, you'll keep him warm for the rest of his life.

      Well there it is! Thanks. Figured I would try to take advantage of an opportunity if I was able. Oh well, was worth a consideration.

        Ok. Bringing this back. Got new orders this week. New orders state I am in ACRP status. Google search doesn't reveal what this is. From the orders:

        SM IS RETAINED ON AD IN ACRP STATUS TO COMPLETE MED CARE AND TREATMENT IN CURRENT RES GRD 10 USC 12322.

        Any thoughts on Residency for purpose of purchasing firearms? Thanks in advance!

          Here's the text of the statute behind "ACRP" orders:

          "A member of a uniformed service described in paragraph (1)(B) or (2)(B) of section 1074a(a) of this title may be ordered to active duty, and a member of a uniformed service described in paragraph (1)(A) or (2)(A) of such section may be continued on active duty, for a period of more than 30 days while the member is being treated for (or recovering from) an injury, illness, or disease incurred or aggravated in the line of duty as described in any of such paragraphs."

          Now all that you need to purchase firearms are "Permanent Duty" orders.

              Thanks fellas! I will look into the legal office. The Permanent duty orders are not going to happen this time around. Doh! Another glimmer of hope snuffed out.

                  Thanks! Not much to do here besides a few appointments a week. So I'm busy trying to figure out how to outsmart CA lawmakers, unsuccessfully I might add. If I were a SPC I would have had this figured out weeks ago! Lol.
