    In CA?

If it is a RAW, then the executor of the deceased's estate can sell it to a CA FFL dealer with an assault weapons permit or to a LE agency through a CA FFL dealer with an assault weapons permit or take it out-of-state and sell it to a FFL dealer in the other State or take it out-of-state and sell it through a FFL dealer in the other State.

Another option for the RAW is it is rendered permanently inoperable (destroyed per BATFE specifications) and the executor of the deceased's estate submits the deregistration paperwork as it be verified destroyed (certified by a gunsmith or firearm manufacturer with proof of destruction) and then sell the parts as a parts kit.

If it is not a RAW, then it's an illegal AW {make/model banned; (make) H&K (model) HK-93 [PC 30510(a)(9) and 11 CCR 5495(a)]}.
The executor of the deceased's estate with the help of their lawyer can arraign to have it surrendered to a LE agency for destruction in lieu of any criminal charges.

Typically, the executor of the deceased's estate has 60 days to facilitate the transfer of all of the firearms in the deceased's estate.
^These firearm transfers do no count towards CA's sell limits by a non-CA FFL dealer.

There are a lot of out-of-CA FFL dealers who would probably love to sell it for you if the lawful executor of the estate drove it to them. Try EBR Works or Audiophil2 on here. I would buy it, but it is worth more $ than I could justify spending. A dealer ( outside CA ) can give you better feedback.

Do you think it would be ok to post it on the marketplace as an out of state sale for him? He doesn’t have any of the paperwork.

            No.

Exposing or offering an assault weapon from sale, while in CA, is a felony. [PC 30600(a)]
^Even if this is to out-of-state buyers only.

              One quick thing.

Is it *truly* an HK93, or an HK93 pattern rifle?

              What's the receiver say?
