COE Needed for out of state C&R Acquisition?

    COE Needed for out of state C&R Acquisition?

    Would anyone be able to clarify if I need a COE to legally purchase a C&R firearm out of state (physically, in person) and bring it back into California, or is a C&R license on its own adequate for this?

    Nope, you only need a C&R for that.

        What about for C&R acquisitions within the state? Also physical, say for instance at a gun show?

          In-state: If you plan to cash and carry a C&R long gun from a private party, or do a same day release from 01 FFL for a C&R handgun or long gun, yes you must have COE.

            Under Current CA laws...

            Exemptions for a CA resident with a valid C&R 03-FFL:
            1. Importing a C&R firearm that they physically acquire while outside of CA without needing to utilize a CA FFL dealer. [PC 27585(b)(1) & 27565]

            Exemptions for a CA resident with a valid C&R 03-FFL and valid COE:
            1. No 10 day waiting period when acquiring a C&R firearm from a CA FFL dealer. [PC 27670]
            2. No 1 in 30 day wait on handguns. [PC 27535(b)(9)]
            3. Can be used as proof of CA residency. [PC 26845(b) & 11 CCR 4045 d.1.]
            4. When acquiring C&R firearms, it is an exemption to needing a valid Firearm Safety Certificate. [PC 31700(a)(6)]
            5. When acquiring C&R firearms, it is an exemption to needing to do a safe handling demonstration. [PC 26850(h) & 26860(g)]
            6. Acquiring a C&R long gun from a non-FFL inside of CA without needing to utilize a CA FFL dealer. [PC 27966]
            7. Acquiring ammunition from a person within CA without needing to utilize a CA DOJ licensed ammunition vendor. [PC 30312(c)(6)]
            9. Either online or in person, importing ammunition acquired out-of-state without needing to utilize a CA DOJ licensed ammunition vendor. [PC 30312(c)(6) & 30314(b)(5)]

              As far as the fingerprinting goes, do I need to have my fingerprints rolled for each application (FFL + COE) or do I only need to have them taken once, and use it for both applications?

                Its been a long time but as I recall, ATF wants a wet ink FBI fingerprint card while DOJ wants a lifescan for the COE. If still true you can get both done at the same place but you can't use one for the other. Maybe someone with more recent experience can chime in.

                          I was originally intending on getting an 07 so I can properly start doing gunsmithing (after schooling for the past four years), but it's just not in the cards. Getting out of California is now on the high priority list for me

                            I believe a Gunsmith needs a 01 FFL.

                              To my knowledge an 07 can still do transfers, etc.
