    Classic Firearms is having a sale on their BM59 rifles, are these transferable in California? A2

    I see a sale on the BM59-RIFLE and there are several other models not on sale. The BM-59 Paratrooper and a couple others with pistol grips probably are not CA legal because of the folding stock - but I suppose it could be pinned. The ones which look like a traditional Garand should be perfectly fine, and the BM59-RIFLE is one of them. However, the 20-round mag needs to be pulled by your dealer assuming they have a high-cap permit to bring it in.

      If it's a parts gun made from a BM-59 and says BM-59 on the receiver, it probably has a tri-compensator on the end of the barrel. That might be considered a flash hider. The original BM-59 is select fire so if the receiver says BM-59 it's almost certainly a parts gun. The original semi-auomatic made by Beretta is the BM-62.

              It used to what it was marketed as. In the guidelines for registering assault weapons they changed that to anything that reduces flash. Also the tri compensator is a grenade launcher so it would count as an evil feature.

                Hmm...anything that reduces flash is any muzzle device.. depending how they measure.. that's lame.

                    Wouldn't this possibly include any of those people that have a fake can welded on to meet OAL requirements? It's so vague.. At what point does the barrel "end".. Eg., if you put a muzzle device even on a 14.5" barrel to create a 16" barrel to not be an SBR then does the flash supression start at the end of the muzzle device? If so then aren't they saying that's still a 14.5" barrel. Makes no sense which of course is how things are here...*sigh*

                      California Code of Regulations Title 11 Divison 5 Chapter 39 Article 2 Section 5471
                      (d) “Barrel length” means the length of the barrel measured as follows: Without consideration of any extensions or protrusions rearward of the closed bolt or breech-face the approved procedure for measuring barrel length is to measure from the closed bolt (or breech-face) to the furthermost end of the barrel or permanently attached muzzle device. Permanent methods of attachment include full-fusion gas or electric steel-seam welding, high-temperature (1100o F) silver soldering, or blind pinning with the pin head welded over. Barrels are measured by inserting a dowel rod into the barrel until the rod stops against the closed bolt or breech-face. The rod is then marked at the furthermost end of the barrel or permanently attached muzzle device, withdrawn from the barrel, and measured.

                        So for measurements sake the muzzle device is part of the "barrel" as far as barrel length. But is it still considered the "barrel" in determining if that pinned device (like a fake can) has flash suppressing abilities and thus is an AW on a featureless Tavor or AR with a pinned brake, etc.. Looks like it's still considered a muzzle device.

                        Something to consider for those that have had pinned muzzle devices on their rifles. I can easily see an overzealous cop/DA saying that a featureless PS90 or Tavor has a flash suppressing muzzle device on the rifle.
