    It isn't "registered" just because of what it put on a 4473.

    A lower should be transferred as "other" since it isn't a handgun nor a long gun. If the firearm is first made into a long gun then it can't be changed into a handgun, that is what matters.

      Ask the FFL dealer that processed the transfer, to find out how it was marked on the ATF 4473 form.



      Also note that...

      Before 11-2011, there was no "other" on the ATF 4473 form.
      There was only "handgun" and "long gun".

      In 11-2011, the ATF 4473 form was amended to include the "other" option.

      However, the pre-"other" ATF 4473 forms were still used until 01-2012.

        In California, it is DROS as a rifle. Every other state it’s as a “other” but not here.

          The CA DROS does not have any affect regarding Federal law issues and therefore doesn't taint the firearm at all.

            That may be,(assuming you've never actually built said lower into a rifle in CA), but serious question then - are CA FFLs transferring a stripped lower as "Rifle" on DROS but still marking "Other" on 4473? Not sure if that's possible, or prohibited, or what.

              It doesn't matter where the lower was made into a rifle as it is Federal law.

              Typically a lower is DROS'd as a long gun since most people are not exempt from the certified list and so it can't be DROS'd as a handgun as it isn't a complete firearm which is on the certified list.

              Regardless of the CA DROS, the 4473 should be marked as "other" for a lower, and in another part marked as "receiver". The "other" is in regards to the types of firearms being transferred, but is not specific to any firearm being transferred. All three boxes could be check if a handgun, long gun and an other are transferred at the same time.

                Thanks for the responses.

                So while my lowers that have never been mated to an upper are DROS'd as a rifle here in California, so long as they were in fact listed as other on the 4473, I can turn into a pistol when I move out?

                  As long as it was never made into a rifle, a receiver can be made into a handgun.
