Kimber Roster question

I have a customer interested in a Kimber Pro Carry II in blue steel .45 ACP. according to the roster, this is the description:

I found one on Gunbroker (https://www.gunbroker.com/item/85389...rf0JjkOCHrf0Tc), but just to make sure, I called up Kimber and gave them the serial number to confirm it is a CA-approved handgun. They said that the manufacturer product number does not have a -CA at the end of the number, and it was a newer model (2014) so it is not a "made for California" model and thus is not the model submitted for testing - tough luck. The CA models were based on a design from 2004-2007.

My point is this - based on the description of the gun on the roster, this model meets the Roster criteria (minus the crimson trace - I was planning on having the seller ship in original configuration). The roster does not specify a manufacturer part number or product code.

Could we as dealers purchase a Kimber that meets the exact description on the roster and place these items for sale? My gut tells me no based on my call with Kimber.

I ran into the same issue with a Springfield Armory 1911. The SA description exactly matches the information on the Roster, but I called SA and they said the same thing as Kimber -- the CA gun was based on a slightly older version of the same pistol. If I remember right, SA gives the old one a CA designation, but that "CA" isn't included in the roster description.

I asked myself the same question "how would anyone know?" Since I knew the details, I decided to stick with the CA version. Had I not known, I bet I could have bought the "newer" version and completed the transfer in ignorant bliss.

Its pretty irritating its this hard to make some of the roster determinations.

Why not just go to a local store and buy a new one? This will only complicate your life.

Thank you Nardo. It is frustrating to go all this length to do the right thing, but I wonder if I need to go to the manufacturer to get a determination every time. Like you said, if I purchase firearms based solely on the roster description, I could potentially be selling firearms that have not been tested.

Here is the million dollar question - would I as a FFL get my status pulled from the centralized list for purchasing and then selling firearms to non-roster exempt individuals based on a description provided on the roster?!?!

I would appreciate any input from Kemsa and Librarian and everybody else who has experienced this.

I have not experienced it, but I can well imagine that you could have problems. If you did it once and it was an easy mistake, then you might get away with it, but if it happened multiple times, then you could have serious problems.

If you don't know, you should check to confirm the firearm is on the certified list as it isn't worth the risk. You might get away with it, but if it gets noticed and they decide to make an example of you, it will be very expensive in many ways.

when i have asked doj to clarify a roster issue, they told me they use the description provided by the manufacturer. it would have helped if all manufactures provided SKU numbers.

the springfield armory 1911 was just one that I caught. I bet there are more lurking there.
