Off Roster Pistols, FFL Relocating

If a California gun store owner (FFL) has off roster pistols in inventory, intended for sale to active peace officers, and the business decides to close and relocate to another state can the FFL take them and simply 4473 them to himself?

Out of state, you follow the federal rules, if you cease business in California there is no way to DROS them in the state. So you would need to transfer them to your new FFL in the new state, then you can dispose them to yourself, but in California you cannot. To the best of my knowledge.

The firearms can't be DROS'd to the owner as there are no exemptions. Depending on how the move is done, the firearms can be transferred to the new location out of state.

There is a potentially one or more months delay from the closing of one FFL licensed premises (California) and the opening of a new licensed premises in another state, BATFE rules do not allow for a transfer or move of a business so a new one has to be established. Kind of a Catch 22.

The wholesaler wants a restocking fee plus shipping even if the guns were never sold.
