    1 in 30 Exemption for FFL3 COE Problem

    Hello Guys,

    Just requesting your input.

    I'm a new FFL3 COE holder and tried to dros 2 modern handguns today. My previous handgun purchase was also less than 30 days.

    My local FFL-1 didn't know how to process this. They were unaware of the 1 in 30 exemption. They are willing to do it if they had the proper info from the DOJ website.

    Could you lead me in the right direction? Thanks in advance.

    There was a CA DOJ bulletin, tell the dealer to check the bulletins in the DES.

        Guys thanks so much! I printed out the bulletin & took it to them. Calguns is such as awesome source of solid info. I truly appreciate it!

          IIRC your last purchase also needed to have the exemption, or it wont matter what you do now. You need to use the exemption *everytime* you purchase if there is any chance at all you may want to purchase again within 30 days.

          I could be mistaken but I seem to remember we had a thread here from someone who found out the hard way.

          Also don’t try it in the city of LA.

            I already drosed and picked up my previous pistol. My COE was already approved at that time but my FFL3 was approved only a couple of wks ago.

            At that time it was just a regular sale. Are you saying there may he a problem with the 2 pistols I just drosed today?

            The the copy of the dros I got today looked good.

              What are you talking about? If it is 1 in 30 exempt, then it shouldn't be a problem, the same as buying a gun, then doing a CA PPT. The transfer is done, in this case, as a C&R w/COE, which is exempt from 1 in 30, but it will also falsely claim that it is exempt from the waiting period.

              The City of LA is an issue.

                Like I said I am not 100% sure, and I looked for the old thread but got sidetracked.

                IIRC there was a guy who did a transfer and it was not marked 1/30 exempt. Then he went to do another transfer in the 30 day window and was denied even though that second transfer was marked exempt. And I can’t remember if one of the transfers was a intra family interstate and not 03/COE.

                Anyhow I don’t have much faith anymore in ‘what should make sense’ when it comes to DOJ shenanigans or ‘programming features’ of DES. And I could have the details backwards, who knows. If I find that other thread I will link it here.

                  There were one time I knew I will be buying 3 new handguns from an FFL who was gonna have a sale. However a week prior I bought one handgun from a different FFL and told them to do a 1-30 exemption on one modern handgun because of exactly what Skyhawk reference to above.

                  If that one handgun was DROS regular 1-30 non-exempt and a week later DROSing 3 handguns exempt, I was worry it would be denied because first handgun non-exempt dros still has to wait 30 days to clear the system.

                  Anyhow, they looked at me all crazy and did the one handgun under exempt.

                  kemasa - if you're saying if I dros the one handgun regular "non-exempt", then a week later dros 3 handguns "exempt" and should have no problems, then awesome thank you for point that out as next time I don't have to worry. In theory if thats the case, just don't do another non-exempt dros for 30 days after that one handgun in my example but any other "non exempt" dros would be just fine. Right?

                    There was/is a problem that the CA DOJ don't see all of the fields, like comments and the 1 in 30 exemption box. I got a call about a 1 in 30 violation where the customer had bought a gun from another dealer which I knew was exempt and then did a transfer through me. I told the DOJ that and was told that they couldn't see things and never heard about it again.

                    It seems it could depend on who looks at, but I have heard that they can see more of the DROS submission now.

                      Also call ahead or ask when you are at the store to verify staff can handle this type of transaction. Sometimes only a manger will know how to process this type of transaction.
