SELLER ID requirement for PPT

Question for FFLs : what's CA DOJ's policy on SELLER's ID requirement for PPT? i.e. can a SELLER with an expired pictured driver license with an interim driver license be allowed to transfer a firearm via PPT DROS while waiting for the new/replacement picture license?

I understand that if the BUYER fails the background check, then the SELLER needs to provide valid ID to receive the firearm back from the FFL within 30 days of the DROS, or complete a new background check if after 30 days of the original DROS.

I contacted CA DOJ but still have not heard back from them on this question.

An expired I’d is not valid so you wouldn’t be able to do the PPT in that case. I don’t care much about the non real or FLA I’d for sellers. But if the buyer fails nics they would need alternate documentation before I would release it. I would never start a PPT with an expired DL.

DOJ has always gone back to the clear evidence of identity verbiage.

12071(c)(1) As used in this article, "clear evidence of his or her identity and age" means eitherofthefollowing:
(A)AvalidCaliforniadriver'slicense.
(B) A valid California identification card issued by the Department of Motor Vehicles.

Expired is not valid so most dealers won't take them I would guess.

Thanks. I read that section and it deals with buyer's ID, not SELLER's ID.

To CA DMV, CHP or any LEO, the interim driver license is a valid driver license anywhere in the US, and major car rental companies will also accept it as a valid driver license for renting cars.

FFL's have to swipe the ID though.... that makes the expired one much more of an issue. I feel like you are just trying to find some PC/CCR that shows a dealer (must) take an expired license but I doubt you will.

Just like some dealers will take FLA licenses on sellers without proof of legal status and some will not. If they don't want to, they are not going to.

I am trying to understand what the real CA DOJ's policy or penal code is since it seems some FFLs are just making stuff up to cover their asses, and making it harder than it should be for people to exercise their 2A rights.

Dealers can only enter manually if the DL does not swipe ....thats in the PC.

Finding a dealer who doesn't want to CYA on a $10 transaction...... good luck.
