    No. It needs fed approval and be listed.

      In general c&r handguns listed or 50+ years are off roster and can be imported

        C&R handguns are exempt from the roster requirement. They still must comply with magazine restrictions and assault weapon restrictions.

            C&R is roster exempt however not in the scenario you present with the 365.

            Must be listed by ATF or 50 years or older.

                Its only updated as needed. Someone actually needs to request that a certain firearm is actually put on the list.

                  They still update it, but there is no way in hell a brown P365 is going to ever make the list. That is until it is 50 years old.

                    Not true, they could make a special version and request that it be put on the C&R list. Look at the list, there are such firearms listed, but there has to be a special aspect to it.

                      They are reluctant to add to the list unless you can prove a special historical or novel characteristic of that gun or model which gives it value for other than functional bullet-launching purposes. An NRA sales promotion model on a commonly available mass produced handgun is unlikely to succeed. A single serial number for one owned by a world renowned celebrity? Possibly.

                      It also takes three or four months to get a decision. If they suspect that the request is intended to circumvent the California roster they will tend to deny the request to list it as a curio.

                        1) how would the feds know that?
                        2) why would the feds care?
                        3) have you seen a recent example of this documented where a manufacturer stated they were trying to get curio approval and were denied because they told the ATF it was to circumvent the CA DOJ Roster?
