    Tell me where I am wrong.

    MP5 pistol clone. under 26" and had a foregrip, BUT we replace the 20 round magazine with a non-replaceable 10 round magazine, mark it; sell it as a MP5 AOW. $5 tax stamp, Form 4 is filed.

    Not and AW (10 round non-detachable mag).
    Not an SBR (under 26")
    Not an evil modified pistol (got the tax stamp) Section 12020(b)8
    Not really a pistol, so no need to be on safe pistol list.

    Or, do I fail on the last part ?

      Under CA laws/regulations...

      A firearm with a a less than 16" barrel length is a "handgun".

      All handguns need to comply with CA generally prohibited weapons laws, CA assault weapons laws, and CA unsafe handgun laws.

      Title 2 AOW are exempt from CA generally prohibited weapons laws.

      Title 2 AOW are not exempt from CA assault weapons laws and CA unsafe handgun laws.

      Therefore...

      In order for a CA FFL dealer to be able to legally transfer a Title 2 AOW, it must be configured so that it complies with CA assault weapon laws and CA unsafe handgun laws.

      Which means for a MP5 style pistol that is a Title 2 AOW to be eligible for importation & transfer in CA:
      1. It can never have been semi-auto.
      2. It must operate as a bolt-action single-shot pistol.
      ^Single-shot being single cartridge loaded directly into chamber and it having a fixed 0 round magazine/sled/block that can not be removed without disassembling the firearm's action or that is permanently attached (welded/epoxied/riveted) into the firearm's magazine well.
