    staying CA compliant.

    hello all. question for my fellow FFLs. i can't find a forum so ill just ask. my brother in another state (CO) wants a AR15 build. however I don't want to get in trouble, so what can I do to build him one with out actually getting a AW permit. there expensive and I don't want to cross that line.

    can I build him a complete lower with no mag lock since there is not such thing as a AW in CO. I have a 07 to do so

    can I send the lower with the upper just not attached ?

    if I build a complete lower is that still considered the AW if it was stored in my safe until I sent it to his FFL ?

    please let me know if any one has information here. I want to stay out of the fire with this Im just not as educated it this Dept.

    There is no constructive intent for CA AW laws. If you build a receiver and add the parts kit and keep the upper separate you would be fine.

    Receivers are not semi-automatic, thus they can't be considered a so called a-salt-weapon.

    Since you are an 07 I would imagine you could do the following, build the receiver and log it as such, then mail the receiver to the FFL in CO and either mail the upper to him or include it with the shipment. Problem is if you include it with the shipment I would imagine that FFL would log it as a "rifle" not a "receiver"

      thank you. that makes since. I was going to log it in my manufacture book then log back to my A&D As a built receiver,

      ill contact the FFL to see how they will log it if I shipped them separate

        Built receiver? A complete receiver is still a receiver, same as a stripped receiver.

        The only question is whether adding parts to a receiver would be considered manufacturing.

        If you do manufacturing, then you need to mark it with your information, so it might be easier for your brother to buy a lower and send it to you, or just buy a complete lower

          The lower is a Spike’s tactical lower so it’s already serialized I have a 07 so that is why I asked the question that after completing the receiver if this would fall
          In the AW definition.

            You do realize that if you complete a firearm it is manufacturing and even though it is marked with the info of who made the lower, you, an an 07FFL, have to mark it with your information, don't you?

                Easy answer is for him to buy his own serialized lower. Build him an upper however you want, gather his lower components, ship it all to him. I'm sure he can find a friend to assemble the lpk, or pay a local store the $50 or less to do that service for him. For such a cheap and common item as a stripped or even complete lower, the extra cost and hassle of processing that transfer is not worth it. I've built many many dozens of ar pattern rifles and tried it all different ways. Having the recipient buy their own lower is always the easiest and usually the cheapest for them after you consider the extra dros fee and hassle of transfer

                  OK. little confused fellas that is why im trying to get all the info first before I make the attempt.

                  so am I getting this correct. if I build the receiver from a spikes tactical and put in the FCG, GRIP, BUFFER TUBE AND STOCK and ship it off to a FFL in CO and they enter it in there A&D as a receiver I am still suppose to add my name and info with serial # on it? im just asking the questions guys. no need to drill me that is why im reaching out. I did ask the FFL how they would enter the incoming firearm and they said they would enter it as a receiver since there won't be a upper.

                    As I understand it, if it just parts on the lower, it isn't manufacturing, but it is a question for the BATF.

                      There isn't constructive intent for federal laws either. You've built an illegal item or you haven't, there is no "Well you might....."
