    There is an entire forum on this topic.

    Its a complicated subject. The FFL is just following the BOEs instructions.

    The law seems to exclude private occasional sales, but the BOE has sent letters to FFLs stating otherwise, that all guns registered from out of state must be taxed.

      Unfortunately yes, with the possible exception of C&R firearms which are from a private party, are an occasional sale and the buyer has a C&R FFL. Shipping is also subject to sales tax since it wasn't shipped directly to the buyer (as it can't be).

      Just to add to the other comment, a legitimate gift from out of state wouldn't be subject to sales tax either.

          What did the invoice say? Im assuming it was a gunbroker purchase or something? Did the guy send it through a FFL, or did he ship it strait to your FFL? How did it go down?

              they can't tax you without an invoice, but i supposed the seller can write out a bill of sale (like you would to pay taxes on a used car).

                    There is proof of what you paid, such as a copy of the check or other means of payment. If it was from an auction site, there is that as well.

                    The FFL is required to collect the correct sales tax, so please don't create problems for them and try to claim a false amount was paid for the firearm as some do.

                    Without proof, the FFL could guess what it might be worth or they might just refuse to do the transfer if you don't provide the required documents.
