    manufacturing of defense articles means something different in reference to DDTC/ITAR than it does ATF


    Registration not Required – Not Manufacturing: In response to questions from persons engaged in the business of gunsmithing, DDTC has found in specific cases that ITAR registration is not required because the following activities do not meet the ordinary, contemporary, common meaning of “manufacturing” that DDTC employs in implementing the ITAR and, therefore, do not constitute “manufacturing” for ITAR purposes:
    a) Occasional assembly of firearm parts and kits that do not require cutting, drilling, or machining;
    b) Firearm repairs involving one-for-one drop-in replacement parts that do not require any cutting, drilling, or machining for installation;
    c) Repairs involving replacement parts that do not improve the accuracy, caliber, or other aspects of firearm operation;
    d) Hydrographic paint or Cerakote application or bluing treatments for a firearm;
    e) Attachment of accessories to a completed firearm without drilling, cutting, or machining—such as attaching a scope, sling, or light to existing mounts or hooks, or attaching a flash suppressor, sound suppressor, muzzle brake, or similar item to a pre- threaded muzzle;
    f) Cosmetic additions and alterations (including engraving) that do not improve the accuracy, caliber, or other aspects of firearm operation beyond its original capabilities;
    g) Machining new dovetails or drilling and tapping new holes for the installation of sights which do not improve the accuracy or operation of the firearm beyond its original capabilities; and
    h) Manual loading or reloading of ammunition of .50 caliber or smaller.
    Activities limited to the domestic sale or resale of firearms, the occasional assembly of firearms without drilling, cutting, or machining, and/or specific gunsmithing activities that do not improve the accuracy, caliber, or operations of the firearm beyond its original capabilities (as described above) are not manufacturing within the context of the ITAR. If you are not manufacturing, exporting, temporarily importing or brokering defense articles or services, you are not required to register with DDTC.



    If you are not drilling/milling/cutting etc you may be a BFF to the ATF but not DDTC. I will get clarification.
    A good example thoigh, handloading under .50 cal is not mfg according to DDTC but if you are in the business of making ammo the ATF says you are a manufacturer. DDTC says it has to be systymated to be a mfg.

      This is the part that is most important to me

      and not all activities involving assembly of and repairs to firearms qualify as manufacturing for ITAR purposes.
      This is where I want to stay for now. Not evading, just avoiding lol nothing wrong with that. Maybe once I get my capital I’ll start having some fun

        Well the big boondoggle here is when they decided to look at gun stuff, and then move a lot of USML Category 1 and 2 from the Dept of State to the Dept of Commerce, they decided that they had to take a fresh look at a new category to add to the USML.
        This category is "Emerging Technologies", electronic and computer stuff, which is all that I have seen in print so far.
        Congress has approved these changes conceptually.

        I have not gone down the rabbit hole researching all this yet due to lack of time, but it seems that the DoC may require some sort of registration for gun part manufacturers like me who would like to export.

        Gunsmithing stuff probably has not been decided.

        I have not heard anything from DoS or DoC yet, although I should be moved from DoS to DoC from what I have read so far.

        The NSSF had a conference about the changes in Wash DC mid November, nothing has been said about it by the NSSF since, but it looks to me like many details are still up in the air right now.

          The thing about all of that is for them to write a new reg they have to get rid of two old ones and DOC doesn’t like getting rid of Regis so that may take a while

            Still confused as to how this affects manufacturing and selling parts in the US. These are all non-firearms, accessories like magazines and monopods and rifle stock parts. My understanding now is that DOD registration is required, but after the rules changes it would not be. For international sales there still will be some doing paperwork and fees to register, even if the new rules change.

            Does this sound about right?

                      As of today, no, if you manufacture defense articles per the Department of states definition, which included alot of things that ATF does not consider manufacturing, like threading a barrel, you must pay ITAR.

                            From today's email from the NSSF:

                            "The Democrat-led majority of the U.S. House of Representatives voted to reverse course on work to modernize export controls. An amendment to the National Defense Authorization Act 2020 passed on near party lines that would halt completion of the Export Control Reform initiative."

                            Well, so much for the last five tears or so of careful consideration of this DDTC / ITAR program and all the reductions (good for us gunnies) and additions (yes, it does make sense to include "emerging technologies") that now won't be done.
