    Manufacturing for LE

    Hello,

    Can a 07 FFL in CA manufacture non roster handguns for law enforcement sale? Or sale out of state? Im looking into making Glocks (like Agency) and 1911s.

    The answer is yes, but the implications can get complicated. If you buy them from another 07 FFL like GLOCK, that work you are doing could be considered re-manufacturing a subject you to a manufacturing tax. Whereas if you buy them from another 01, or an 08 you could argue that you're just modifying them with parts.

      By tax you mean FET?

      Thank you. Since I would like to get a variance under my name - all this would take is a 07 and making sure I pay FET so I could build from scratch Glocks/1911s to sell to LEO and out of state? Just want to be clear.

      Also, for custom AR rifles and suppressors, I would need a SOT and a DWP, correct?

        Suppressors would be SOT, otherwise basic manufacturing.

          DWP are firearm specific...
          For firearms that CA considers assault weapons, you will need a DWP for AW.
          For firearms that CA considers DD, you will need a DWP for DD and be a SOT.
          For firearms that CA considers MG, you will need a DWP for MG and be a SOT.
          For firearms that CA considers SBR, you will need a DWP for SBR and be a SOT.
          For firearms that CA considers SBS, you will need a DWP for SBS and be a SOT.

          DWPs require documentation from Gov/Mil/LE agencies showing their intent to buy from you and/or Gov/Mil/LE contracts for the firearms.

            Curious, since I see companies like agency arms manufacturing their own glock model on a lone wolf frame, but also selling gunsmitbing packages on customer supplied guns, is that just a way to minimize FET?

              Working on customer guns would be "gunsmithing" and not be subject to manufacturing tax. Also only requires 01 FFL.

              It maybe subject to ITAR depending on what modifications are performed.

                Hi,

                I've been looking for what I believe was just answered here, but I wanted to double check to make sure I'm not still confused on the issue.

                If I were to manufacture a double action revolver that will not be for sale in California, the revolver being manufactured would not have to be on the Roster?

                    32000. (a) A person in this state who manufactures or causes to be manufactured, imports into the state for sale, keeps for sale, offers or exposes for sale, gives, or lends an unsafe handgun shall be punished by imprisonment in a county jail not exceeding one year.

                    I think your SOL.

                        I've read through the rest of the section a few times now and I think I must keep missing something. Is manufacturing only allowed if your prototyping for CA testing? Or is it legal to manufacture for Law Enforcement purchases or out of state sale? When I read the law enforcement portion, the way it reads to me is related solely for the sale portion and not the manufacture portion. But honestly I'm very uneducated when it comes to interpretation of law.

                          So, to be clear, we don’t manufacture. However, there are a few real manufacturers in the state. (franklin for example) What I was point out is that the law has exemptions for different activities.

                          We certainly do bring in off roster pistols and hicap mags but they can only be sold to an exempt class. An FFL has the exemption to bring in and sell these items to customers like police officers.
