    Did a PPT and buyer failed DROS

    Last Friday, I met with a fellow Calguns member to PPT my Glock 23. April 2nd would be day 10 and he would be legal to pick it up, the DROS came back today as denied. The gun store manager called myself and the buyer to notify us. The manager told me today that I have to wait for the 10 days to be completed before I can pick up the gun, is this true? Or can I go and pick it up this weekend?

    I have already worked out things with the other party, but I would like to have the gun back in my possession before money is given back to the other party.

      FFL was given a NICS number on YOU when DOJ called to give them the denial info. You can just go pick it up at the LGS. But it sounds like the LGS doesn't know that.

        Per CA PC, it is to be returned immediately. They can call the CA DOJ.

        I wouldn't refund any money until you have it back and it is the same condition.

          Schedule with the other party to meet at your FFL ASAP, get your gun and give him the money - even exchange and assures your pistol is in same condition when it left you 10 days prior

            I would find out why denied from buyer. Keep some money for inconvenience. Give rest back. Gas Money etc.They cannot keep gun for 10 days on denied. At least you have your money already.

              Applicable CA laws... see part in bold...

              Penal Code 28050
              (d) If the dealer cannot legally deliver the firearm to the purchaser or transferee or the person being loaned the firearm, the dealer shall forthwith, without waiting for the conclusion of the waiting period described in Sections 26815 and 27540, return the firearm to the transferor or seller or the person loaning the firearm. The dealer shall not return the firearm to the seller or transferor or the person loaning the firearm when to do so would constitute a violation of Section 27500, 27505, 27515, 27520, 27525, 27530, or 27535. If the dealer cannot legally return the firearm to the transferor or seller or the person loaning the firearm, then the dealer shall forthwith deliver the firearm to the sheriff of the county or the chief of police or other head of a municipal police department of any city or city and county, who shall then dispose of the firearm in the manner provided by Sections 18000, 18005, and 34000.

                  Welcome to the club OP. I had this happen only once.

                  Although this sucks, I gave the buyer all his money back. No travel involved.
                  He called me a couple months later after he got his problem fixed, but I sold the gun.
                  There's another buyer waiting out there for that gun, relist it!

                    Now the person who entered the DROs, screwed up the serial number and now the manager doesnt know if he can release my gun back to me.

                      Then is the shop in legal possession of your firearm to deny it being given back?

                        Hummmm.....so the buyer seller and shop employee didn't check the serial number on the dros preview BEFORE it was submitted to the DES?

                          Go to DES, correct dros. Enter correct serial number submit. Problem solved.

                              Sounds like a refund is in order since the FFL incorrectly submitted the serial number :-).
