Trap gun CA Compliant?

Does anyone know if of PC that makes a trap gun illegal?

I found a PC that says you cannot set or cause to be set or take game with one, but im talking about possession and registration?

DIVISION 3. BOOBYTRAP [20110- 20110.] ( Division 3 added by Stats. 2010, Ch. 711, Sec. 6. )

20110.

(a) Except as provided in Chapter 1 (commencing with Section 18710) of Division 5 of Title 2, any person who assembles, maintains, places, or causes to be placed a boobytrap device is guilty of a felony punishable by imprisonment pursuant to subdivision (h) of Section 1170 for two, three, or five years.

(b) Possession of any device with the intent to use the device as a boobytrap is punishable by imprisonment pursuant to subdivision (h) of Section 1170, or in a county jail not exceeding one year, or by a fine not exceeding five thousand dollars ($5,000), or by both that fine and imprisonment.

'Possession with intent to use' is a crime. Presumably, 'possession with intent to have a curio in your collection' might not be a crime.

Hmm. Short barrel that uses fixed ammo. Not a problem federally since C&R. CA may consider it a SBR/SBS? I have no idea. I was not even aware that such a device existed! Sorry, I'm no help..

Didn't chime in but we did start to look into the legality before we got busy and never completed the thought. So we didn't comment, but rest assured we did google the thing and said, hummm this is odd.

I'm waiting to get some word back on the DOJ.

My idea is that it will be "technically legal" though CA wont have a strait forward way to register it.

They did once tell me to register a winchester 14.5" trapper rifle as a pistol once lol

Given that it was used initially for the taking of game, you might consider checking with Fish & Wildlife.

If my memory is correct I heard of these devices from a state employed trapper that said around the era when predators, ie wolves, coyotes, bear etc were decimating stock herds they would use these type of devices to instantly dispatch animals upon the taking of the bait. They were mostly used 1880s to early 1900s, obviously before PETA.

They were outlawed in the 30s-40s almost universally, and it is illegal in CA to take fame with them. I dont care what Fish and Game says, i want to know hows the CA DOJ sees possession lol

A "trap gun" has a smoothbore barrel length of less than 18" and an overall length of less than 26".

Under CA laws...

A firearm with a non-rifled barrel, whose length is less than 18" or whose overall length is less than 26", is an "unconventional pistol". [PC 17270]

This means a "trap gun" is classified as an "unconventional pistol".

It's illegal (felony) to make, import, transfer, or possess an "unconventional pistol" in CA. [PC 31500]
In addition, "unconventional pistol" are subject to confiscation as nusiance items. [PC 31590]

However, there is a C&R exemption for "uncoventional pistol". [PC 17705(a)]
But, being C&R may not stop the initial confiscation of it as a nusiance item and showing proof that it is a C&R would be required in order to re-acquire it after confiscation by LEOs.


Therefore...

A modern production "trap gun" is illegal to import, make, transfer, or possess in CA.

A C&R "trap gun" is legal to import, transfer, or possess in CA.


Keep in mind, while in CA...

Using the "trap gun" or keeping it with the intent to use it, can run afoul CA boobytrap laws. [PC 20110]

There is no C&R exemptions to CA boobytrap laws.

In order to not run afoul CA boobytrap laws, it would be prudent to have the unloaded C&R "trap gun" in a presentation case/display with plaque (describing it's C&R status/history). The presentation case/display with plaque is a way to show proof that it's a C&R (to prevent confiscationas a nusiance item) and there is no intent to use it (as a boobytrap).
