    Inter Family Gift - Need help (OR to CA)

    I have a family member (direct parent), that would like to gift me a new firearm that is off roster. They are in Oregon, I am in CA.

    All of the FFL's I have spoken to in CA are ok with this, and I'm looking to do it through Ammo Bros. I know it takes a written letter of gifting, serial number, a 10 round mag included with the firearm and the 15/17 round removed, etc.

    What I cannot find, is any store in firearms dealer in Western Oregon that is willing to do the FFL transfer. I've contacted at least a dozen and everyone of them says "We aren't comfortable transferring to California."

    Does anyone know of an FFL between Portland and Eugene OR, that they have worked with before, that is willing to do this transfer?

      Well due to financial stuff, it's often easier for me to visit there, than them visit here. I will be up there in a couple weeks but that doesn't help with this

        use Shipmygun.com and have the folks send it directly to your FFL if Ammo Bros will accept a shipment from a non licensee.

          I can't find anywhere under the interfamilial transfer law that lets me avoid the FFL to FFL transfer rule... am I missing something? Also the person I spoke to said no, they won't accept non-licensed

            There is no requirement that an out of state FFL ship to your CA FFL. There is no state law that says that, and there is no federal law that says that. The fact that this is an intra family gift of an off roster pistol has no bearing on that. The law simply says you must transfer this through a FFL in CA. That's it. If you have a legal citation that says otherwise, post it and we can review/clarify it.

            So anyhow what you are discovering is that this process is easier said than done. Having a *good* FFL and established relationship with that FFL is worth its weight in gold.

            You have three choices:

            1) You find an out of state FFL who is willing to (a) enroll in the CA DOJ CFLC system and then (b) obtain, print, and include in the shipment a CFLC approval for that firearm to be shipped, and then (c) ship that firearm to a CA FFL.

            2) You find an in state FFL who is willing to accept a shipment directly from a non licensee and then transfer that using the intra family off roster exemption.

            The benefit of having your parent ship, is they do not need to get CFLC approval first. The downside is it requires them to take the firearm to a hub or customer service counter, and *not* a retail outlet like a UPS Store, Kinkos, etc.

            3) Your parent brings it to CA and you find a CA FFL who is willing to accept a walk-in transfer from an out of state non-licensee and also willing to do a roster exempt intra family transfer to you.

              California Firearms Licensee Check (CFLC) Program Are there any costs or fees to obtain a Firearms Shipment Approval number from the Department of Jusice (DOJ)? I am not a Federal Firearms Licensee (FFL) but I want to ship a firearm from another state to an FFL in California. Do I need to obtain a Firearm Verification Number before shipping a firearm to California? I am an FFL in California. How does the CFLC program affect me?               No. Only shipments from Federal Firearms Licensees (FFL) require a Firearms Shipment Approval number.

              Yes. You must obtain a Firearms Shipment Approval number from DOJ prior to shipping a firearm to a California FFL. You will need to enroll in the CFLC program to obtain Firearms Shipment Approval numbers.


              May a nonlicensee ship a firearm by common or contract carrier?
              A nonlicensee may ship a firearm by a common or contract carrier to a resident of his or her or her own State or to a licensee in any State. A common or contract carrier must be used to ship a handgun. In addition, Federal law requires that the carrier be notified that the shipment contains a firearm or ammunition, prohibits common or contract carriers from requiring or causing any label to be placed on any package indicating that it contains a firearm and requires obtaining written acknowledgement of receipt.

                Thank you Skyhawk, I really appreciate all of the clarifications on this. You have helped quite a bit. I will talk to some of the FFL's in my area and see what I can work out with them. I very much appreciate it.

                  The one thing that you do have to watch out for is you bringing it down with a letter and ID since CA has the new firearms "loaning" laws that affect both the loaner and borrower (only if CA resident). I haven't dug deep enough into it, but I'm sure that others who have can chime in.

                    I am in a similar situation. Just find a FFL here in CA that will accept the shipment directly from your parent. Post your location here, I guarantee within a day you will have a FFL reply to you willing to help out.

                        I don't know of any FFL here on CGN that won't accept directly from a seller.

                          Admittedly, I am open to an FFL that is willing, but the Turners near me and Ammo Bros, told me no. I don't know of a local to go to instead, suggestions?
