    Unusual situation

    I have a customer that has inherited a few firearms from a deceased (in state) brother in So. Cal. He mistakenly had them shipped (by the S.Berdo.Co.SO) to the wrong FFL here in No. Cal. The FFL in possession of them is refusing to release them to the intended FFL even though the intended FFL is willing to pick them up with the appropriate paperwork. The customer is very concerned since the FFL is threatening to have them destroyed or may be wanting to keep them for himself. FFL does not have a very good rep.

    Can anyone think of some recourse the customer might have to get the FFL in possession of them to release them?

    I suggested he file a Grand Theft report with the local S.O. if necessary.

    So, now it is ironic that the State whittles away at the right of its citizens to defend themselves from the possible oppression of their State.

      So the sheriff made a mistake or the customer did? Curious what legal reason this FFL has to not give them to a different FFL. Now, I can see if the FFL in norcal wants to be paid for his time of receiving these and logging them in and back out.

        Threatening to destroy the firearms?

        Yea, get SO involved. That FFL is opening themselves up to heavy civil liability for sure.

            The owner of the firearms had them sent to the wrong FFL since the two business have similar names. Not the SO's fault. The FFL in possession of the items is a real human appendage...has a bad reputation within the surrounding area for doing shady/possibly illegal stuff.
            The owner has offered to pay $100 for the time spent logging in, etc. FFL refused the $$. Told the owner that if he didn't DROS them thru him he'd have them destroyed or "just keep them".
            ATF & DOJ really need to do an inspection on this business but I don't know if that can be initiated.

                  Just get local PD or SO involved. It's not abandoned property, so the FFL has no standing there. The intended owner has done his due-diligence to rectify.

                  I also recommend, what others have, and seek an attorney if common civilities aren't working.
