Is my FFL required to collect tax when doing the DROS on a free Glock I received from mailing in a GSSF certificate? This is the certificate that gets you a free gun, not the one that simply gets you a discount.

If the gift is over $600 the mfg would send a 1099 to the recipient. Personal experience. I got free guns from multiple mfg and anything over $600 they send the tax docs strait to me.ShootSoCal Firearms & Training.

Based on my knowledge, if you are not paying for the firearm then it is not subject to sales tax. You can ask the now renamed BOE about it. This does NOT include trades and such which would require sales tax be collected.Kemasa.

The only sales tax for the FFL to assess would be on any upgrades over an above the free gun, and it would only be the difference between what tax rate GLOCK charges you, and the state / local rate.
For Example:
You upgraded to a GLOCK 34 or 35 and paid $106.00 upgrade fee. If GLOCK charges you 7% on the $106.00 you'd only be liable for the difference in tax between 7% and your local rate.Comment
