How do you get a shotgun into the "system"?

    Asking for a friend:

If a shotgun was transferred years ago with no documentation, how do you get it into the system now?

The transferor is no longer around, don't know who they were, can't find them now.

Does the gun have a chain of title?

Also, if it is being used regularly by transferee (hunting, trap, skeet), it that legal?

Depends on how long "years ago" is. No such thing as title/registration on long guns till 2014

From what I've heard, it was pre-2014.

Just because its pre 2014 doesn't discount a possible illegal transfer.

I don't recall off the top of my head when it was legal in CA to transfer long guns without the use of an FFL That would be the important date. You might want to look that up for reference.

That updated law was to make C&R long guns go through an FFL if im not mistaken.

I'm sure my friend doesn't care since they don't plan on selling it.

They were just wondering if it gets handed down again to a family member, is there an issue about proving ownership if the proper forms are now submitted?

If it gets handed down any time from now and until the law changes an intrafamilial transfer form must be completed if it applies or the oplaw if applicable. Otherwise, if neither of those apply then it needs to be a PPT.

What happened prior to the original owner getting it isn't as important as what happens to it now and if that's done legally or not.

That seems to indicate to me that 1-1-11 was the effective date where you had to use an FFL for all firearms transfers.
That date was the new numbering date; actual requirement took effect 1-1-1990.

Intrafamilial did not need the OPLAW for long guns until 2014, same year DROS started to collect info for long guns same as hand guns. Similarly, C&R long guns could be transferred without FFL until the law changed for 2014.

Maybe transferring a firearm without going through a dealer is a good way for you to end up in the system.... Somebody had to say it.

Interesting; so, purely fictional scenario: an elderly gentlemen who bought a Winchester 52 in 1953, which was not registered of course, could not have legally sold that gun to another party in 1995 to someone else, WITHOUT going thru an FFL?

And the DOJ would get the offending criminal into the system exactly how?

Just trying to understand the law here, to fully comply with it of course.

Now practically speaking there wouldn't be any way to prove the transfer happened in 1995 since there wouldn't be a record of this unless either party admits to it. I doubt any DA or DOJ field agent would car to prosecute or deal with this transaction. But legally speaking transferring firearms that do not meet the exemption to not use an FFL may be prosecuted and Librarian has already posted the PC on it.
