    Ammo and FFL03/COE

    I've found a bunch of information pertaining to FFL01's and how they are dealing with the new regs for ammo sales after the 1st, and I also see where '03's are supposed to be OK, and not in need of a Vendor's Permit, but I can't find it anywhere where it states this?? Most of the flap pertains to FFL01's and that they are considered an ammo dealer automatically. All other non-retailers need to apply for a ammo vendors permit. I always thought the FFL03 was for collecting and is not considered a retail license. So what I would like to know is how an FL03 is ammo exempt, and where is states that... Just curious as I don't plan on selling ammo, but it would be nice to know....??

    Also would like to know how the new regs are going to effect the gun show ammo vendors?? I've picked up a little manufactured ammo at shows in the past. Is this over??

    A 03FFL with a COE is exempt from the purchasing requirements of going through a dealer. They are not exempt from the selling requirements.
    Anyone selling more than 500 rounds a month is required to get a vendors license.

      (e) This section shall not apply to the sale, delivery, or transfer of ammunition to any of the following, if properly identified prior to the delivery of the ammunition by the vendor:

      (8) A person who is licensed as a collector of firearms pursuant to Chapter 44 (commencing with Section 921) of Title 18 of the United States Code and the regulations issued pursuant thereto, whose licensed premises are within this state, and who has a current certificate of eligibility issued by the department pursuant to Section 26710.

      30312
      (c) Subdivision Subdivisions (a) and (b) shall not apply to or affect the sale, delivery, or transfer of handgun ammunition to any of the following:

      (6) A person who is licensed as a collector of firearms pursuant to Chapter 44 (commencing with Section 921) of Title 18 of the United States Code and the regulations issued pursuant thereto, whose licensed premises are within this state, and who has a current certificate of eligibility issued by the Department of Justice pursuant to Section 26710.

      30314
      (a) Commencing January 1, 2018, a resident of this state shall not bring or transport into this state any ammunition that he or she purchased or otherwise obtained from outside of this state unless he or she first has that ammunition delivered to a licensed ammunition vendor for delivery to that resident pursuant to the procedures set forth in Section 30312.

      (b) Subdivision (a) does not apply to any of the following:

      (5) A person who is licensed as a collector of firearms pursuant to Chapter 44 (commencing with Section 921) of Title 18 of the United States Code and the regulations issued pursuant thereto, whose licensed premises are within this state, and who has a current certificate of eligibility issued by the Department of Justice pursuant toSection 26710.

        Thanks for the post of the regs. Lots of legalese and had to uncross my eyes a few times, but in the end it finally made sense....

          As I understand the laws, and the future changes to purchase certification on July 2019, anyone who is not an FFL dealer that has a COE should apply for the FFL03 and get the exemptions.

          Online purchases can be shipped to the FFL03 address without having to do the DROS process, no buyer certificate needed when those go into effect next year, and FFLO3+COE can import ammo into the state (driving from Oregon, Nevada, Arizona) in accordance with the law.
