US Work Permit

Not sure on this one, and the customer is just asking, can somebody here on a work permit purchase a firearm. He does have a valid CA ID and it does not have any of the federal restrictions wording on it. He has a card that is supposedly his work permit/visa and he had a Mexico passport (at home but he didn't bring it today)

He came in to shop for other things, he ended up buying a snare drum, but saw the firearms and asked if it was lawful for him to buy one. We told him we would double check and if he was serious about buying we would have the answer when he comes back to look closer.

Anybody have any help on this. I didn't want to call ATF and bother them since he was not looking to make a purchase today anyhow and was just asking for future reference.

I assume he is a nonimmigrant (12d.).

It looks like it is no, with limited exceptions. See the 4473 instructions for 18c.

Opps, 18.c. is a list of OR, not AND, so a hunting license or other reasons make it acceptable.

H1B visa? needs I-94 plus a valid hunting licence, Id and passport plus copy his visa. make sure its still valid. Ive gone as far as to verify current employment status. also on the 4473 there are specific parts about non immigrant buyers.

I'm not sure what visa he holds exactly. Like I said he came in looking at musical instruments. But I'm sure he will be back if he's serious about buying. Thanks for the quick help.

I-94# and a Valid Hunting lisence hunting lisence (or a letter from the Attorney General) with a CA ID/DL or a Miltiary ID and PCS orders is the only options I know of.

The Fed requirement is the hunting licences, but the state will still require the ID/DL or CAC with PCS
