Can I transfer wife's firearm?

    Can I transfer wife's firearm?

    I looked around but cannot find a difinitive answer.

    We are moving out of state. Want to leave non-roster stuff behind. Wife has 2-3 in her name but her schedule makes meeting much tougher than it is on me.

    Can I do the (seller) transfer on "her" guns without filing paperwork prior with the DOJ?

    IF NO.....what's the fast, simply way of putting me on them (Ownership)? Can it be done so that we are both on them so that either can transfer?

    This will be much easier in Alaska!

    No. They're her's and thus she should be the one to sell it, Should she given them to you to sell then she would be unlawfully transferring it to you.

    You and her can go PPT them to you at your LGS. However, if she has time for this she should have time to PPT them to another buyer too. I would suggest maybe seeing if somebody here on CG will buy all her's at one time, sort of a take all package deal. Then she only has to go once to the LGS. Call your FFL beforehand to set it up and save time. Gun's in CA can't be registered to two people. Sorry

      Why can't we do an intra-family transfer that does not require a trip to a LGS? Spouse to Spouse? Has something changed?

          you can show up and sell her guns. No problem. Like any situation with
          Tin foil hat FFLs, best stay quiet.

          I sold a dozen guns for others who were dead or sick. The CDOJ doesn't backtrack.

              Good Practice and respect for ownership norms tell us we should not sell things we do not own.

              As a practical matter, since not all guns are known to the State, the seller's legal possession is not checked.

                So if the oplaw form is to be submitted within 30 days? If you don't possess them after 30 days, would that grace period be legal to transfer prior to 30? Without submitting the oplaw of course.

                  She could go to the FFL and fill out a DROS worksheet.

                  A transfer to a spouse can be done, but it seems to take time for the CA DOJ to process it.

                  It should not be about what you can get away with, as some have suggested.

                    I've had a lot of customers complain about the Intra-Familial Transfer process. Many have never had the firearm transferred even though they have cashed their checks.

                    If you do the Intra-Familial transfer, make sure you keep a copy of the form for your records. Also retain the cancelled check they cashed when they accepted the paperwork. Also, I send everything to CaDoJ via Priority Mail so I have a copy of the tracking that they received it.

                        While Cal Guns can never condone breaking rules and regulations I consider my
                        Wife's guns equally mine because of Community Property.

                        I seriously doubt ANY issues will arise as long as the husband doesn't belch
                        out any information. You can be the SELLER OP.

                        When my Uncle passed he had no wife to inherit. I just scooped up his guns and sold them via PPT. Money dispersed to 1st Cousins. I was the SELLER.

                        I am not worried at all about CDOJ. I am on their do not bother list because of my 11 RAWS. Haha.

                        I will state that for me and not any others who read this that I am not turning in
                        my high capacity magazines. Ever.

                        All my current rifles are Featureless and will never be RAWS.

                          Then you admit you transferred guns illegally?

                          Can you pass that joint or share that bottle with me? You need help and I hate these stupid CA laws but they still exist

                            Yes I've had RAWS since Roberti-Roos in 1989. 11 weapons. My registration is current and I dislike this ridiculous law.

                            Yes, I transferred guns for family and please note that these laws are "Regulatory" and not "Primary" proactive laws that are enforced, sought after and on the front burner by LE everyday.

                            These "Regulatory" laws like the High Capacity Magazine Ban are usually "Added on" by a Prosecutor after a Perp robs a bank with a full house AK 47 and additional charges would include having an unregistered assault weapon, high capacity magazine and San Francisco I wouldn't be surprised if they didn't add hollow point bullets...

                            My current long guns are indeed Featureless because I dislike RAW restrictions.
                            Many are unregistered (pre 2014) and I intend to keep them that way.

                            Yes, the CDOJ can pound sand.

                            I don't do dope but I love good tequila and Bourbon Whiskey.
