    Restraining order firearm pick up

    Have a customer that has 24hrs to drop off his collection due to family issues and him being served a restraining order. I'm an 01 dealer. What is required from him and me to collect the firearms until they can either be transferred back to the customer or to another party? Usually do SO PICKUPS that come with paperwork already.

    I have not had to deal with it, so I don't know all the details.

    A web search shows that Russel Tactical does it, so you could try calling and see if he is helpful to other FFLs.

      They should have a form from the court that you fill out. You will list the firearms information and your FFL information. It's normally buried pretty far back in the packet of court paperwork they received when they were served. They need to turn this into the court.

        Ok I'll have to look tomorrow when customer brings their stuff. As far as transferring back do I just run it as a basic dealer sale in DES? Figure if they can't have them in the long run then it would be a private party transfer but usually my normal SO transfers are to a friend or family member when customer can't keep them.

          You also have to fill out the BOF 992 form and mail it to CA DOJ. The form is found in DES.
          I was instructed that all can be transferred at one time and put BOF992 return in the notes. Should be 1 in 30 exempt as well as a return to owner.

            Yes, to return it we run a DROS. We normally intake them the same as a consignment with the BOF 992 added.

                Unless it is gunsmithing work, a 4473 is required to return the firearm to the customer.
