which box to check on application FFL01

SOOOOOOO......trying to finish this FFL01 application but am not sure how to answer one of the questions so thought i'd ask.

for box 17 - "Indicate type of business premises".

i live in an apartment which would be "zoned residential" but i plan on only selling firearms online. i'm going to try to work out being able to drop ship to the customers FFL, but i'm sure there might be cases where they have to be delivered to me first.....but since the location of the business is going to be strictly through the internet i was wondering if you could or should put "Zoned Commercial/Other/Internet.....because i would not have a storefront and no customers would be coming to my apartment. it would all just be internet based.

i'm no longer in cali.......moved to las vegas, the city of dangerous rude people...lol........not that that would make a difference (?)

    what do ya think?
    thanks in advance!

You still have to have a licensed premises and as I recall you need permission from the landlord. The location of your business would still be the apartment.

This! You have to have a place of buisness for DOJ to show up. Have a good coffee maker available.

You can bet someone will show up after you open for business to hit you with fines and penalties.

Oh and proper gun safes. You have to show you have storage. Your insurance will insist on security measures.

He is in Nevada, but the BATF still shows up, as well as whoever in NV who oversees businesses.

I downloaded the application to be able to give a better answer.

Item 17. Indicate Type of Business Premises.

There is no "Zoned Commercial/Other/Internet" option. Your business location would be under "Zoned Residential" and would be "Condominium/Apartment".

I hope if you fill it out that you have talked to your landlord since Item 16 wants their info and it is likely that they will talk to them.

I must admit that it is a bit funny to see "Hotel/Motel" as an option, but perhaps that is just a trick.

Item 18, 18a and 19 are funny as well due to the "do not submit application" comment.

i added the "internet" part as the prescription for commercial "other".
yes, i know i have to ask the landlord for permission and have to have a gun safe, etc. coffee maker already covered.

But your location is not commercial, it is residential. The Internet is not a location.

ATF is not a comedians audience. I suggest answering the questions without trying to convince them of what you think. They can be easy to deal with if you are straight and to the point. This doesn't change after you get your FFL either.

Then again, making false statements on a Federal form can be funny to those watching, although not for the person who does it.

I suspect it would not go well to claim a residential apartment is commercial.

i think you misunderstood. i'm not taking this as a joke. i just thought there might be different rules for and internet business where my distributor drop shipped all my orders to my customers FFLs. i know a distributor who would do that if i purchased a particular quantity in advance, so i could essentially have it where i'm almost just like a broker and i would not have any guns on premise. I think it's a legitimate question. sorry if you thought it was a joke, but i'm taking it all seriously and want to do it all correctly..........which is why i asked the question.

rules do and can change if things are strictly internet......which is why amazon.com was able to avoid taxes for so many years. but i thank you for taking my question seriously. maybe i should have written the initial question differently. my fault. but much appreciated, Taperxz! sometimes i ask dumb questions, or odd questions, but it's just becuase i've thought of things from a different angle. i'm not trying to get around rules/laws, just curious if things change when you don't have guns on premise and you don't have any storefront. does that make sense?

Your location is your location period. It does not change.

I'm not misunderstanding at all. My point was, stop thinking outside the box. As Kemasa stated, "your location is your location". ATF doesn't care what your situation is as long as your other ducks are in a row.

You are trying to out think something that doesn't need to be out thought. Go with what you have and let the cards fall where they fall.

My thoughts, drop shipping and internet sales are a tough gig when you are competing against places like Buds, Davidson, and grab a gun who buy in bulk and will get the better pricing. You would be better off taking in guns at least for transfers but that would be difficult in an apartment with the "drug dealer" type traffic. J/K

It is not really thinking outside the box, it is trying to play games and the government does not like games so you tend to lose. No thought to the reaction from the BATF when they go to an apartment, not a commercial property. Things will not go well and most likely the application would be denied, at best.
