    What Happens When An FFL Dies?

    When the FFL holder of a gun store dies, what happens to all of the guns in inventory and in 10 day jail?

    Can the employees, wife, kids, etc keep selling/delivering them? Do they get frozen? What exactly happens?

      It depends on who is listed on the FFL. If it's just the Person who died then the guns are normally taken to another FFL to be transferred. Sometimes it's the local PD who will take the guns until another FFL is found to buy the stock and transfer the consignments and holds. ATF will come in and take the records.

      If you are lucky then there will be another responsible party on the FFL who can either continue the business or wind it down in a controlled fashion.

        It sounds like it could potentially turn into a purgatory-like nightmare...

          I believe the spouse can continue business for 90 days after they notify the ATF licensing unit if the ffl is a sole proprietor. After the 90 days the records are turned over to ATF or if business is taken over by new ffl, the new ffl can assume control of the records with ATF notification. Been quite awhile since I looked into it, back in 07 when I got my 01 ffl. My wife for a time was a responsible party, but I removed her since CA wouldn't allow her on the cfd.

              Is this because you are a sole proprietor? My wife and I are both on our CFD, but we're an LLC.

                Yes. I want to give .ca as little as possible in tax revenue. Running as an old or Corp just gives .ca extra money for the amount of business I do. I no longer sell just transfer and build when I choose to.

                  So you can have 2 people on the CFD? Is there a max number of people you can have on it?

                  Can you have 2 or more people on the FFL? Would this even be necessary if it is a Corporation?

                    Our FFL is an LLC. The CFD doesn't list our company name on it. We receive 2 CFD letters each with our own individual name and COE # on it. I don't know if there's a limit. There's only 2 of us

If only the FFL, the ATF will seek another FFL to handle the dispositions of the customer inventory. We have been involved in such an instance.. . .thank goodness it was only 50 or so guns. I can't imagine if I were to keel over and leave what I have to others. . . .yikes!!!

                        So are you saying that if it is a corporation, you can have multiple people listed on the same FFL?

                          We have multiple names on our O7?? That question is best for the ATF when such unusual things happen. But when an FFL dies, the ATF can do what it wants. In the case we were involved in, the FFL was a sole prop and the ATF wanted guns out of the Non-FFL's relatives hands in a reasonably short period of time. Still, over a week went by that the relative had them. . . .

                            The ATF has provisions for an executor or family member to temporarily continue operation on the FFL, which would accommodate transferring guns to another FFL, but I'm guessing the DOJ would put the kabosh on transferring anything to individuals.

                            If you have beneficiaries that will be counting on the value of you inventory, I suggest you put a plan in place to have and executor immediately transfer all the guns to another dealer. The few people affected by having to re-dros via another dealer will get over it. The most important thing is your hard earned assets don't end up in the hands of the state or as some ugly assed anti-gun statue in San Francisco.

                            When I rescued the inventory from a now-defunct dealer, they were just a day away from being turned into LE. He wasn't even dead! Just "prohibited" under our draconian CA laws...
