Gift, Tax Exemption

Doing a transfer. Pistol was a promotional gift, no charge to the client.

On the receipt is printed: "280.0360 Gift, no tax."

I looked up the code, it reads, "280.0360 Deposit of Gift in Mail out-of-state passes title at that time, and donor is not liable for use tax. 7/18/50."

So, no need to collect?

I just asked Kemasa about this last week in a PM. Sounds like a Front Sight order to me and I haven't been collecting tax on those.

As far as I know, it is not subject to CA sales tax. The giver of the gift might owe sales tax in the state where it is from, but that is not our problem.
