Need help retrieving guns from the LAPD GND Unit (Guns and Narcotics Division

Have someone who got locked up for a 5150 and all his firearms were turned over to the LAPD GNU Unit. Since he cannot have them he wants us to retrieve them from the LAPD and sell them out of state. He originally wanted us to sell them to his friends but I told him we cannot as that could be seen as a straw purchase but would be happy to sell them out of state on his behalf.

I have the DR number of the case and have been trying to get info from the LAPD but I keep getting a run around and no one seems to know what I can or need to do. I have spoken to the department directly and I am waiting for a few calls back.

Anyone have any insight or information? Never done this before.

why would it be a straw purchase?

SCOTUS ruled that a felon could have his firearms collection transfered to a friend or spouse and it would be legal provided that the recipient does not grant access to the prohibited person.

Do you want an AOW or C&R SBS/SBR in CA?

Same reason an FFL is getting sued by 2 cops who sold a gun to someone not on the invoice. If anything happens how much is it going to cost to prove yourself right.

It was just murky and I wasn't wanted to get into those waters.

How would selling them to his friend be any different than when you get a DROS denial and the accompanying form that says they must dispose of any firearms into their possession? Doesn't the PC specifically state they can sell them? I do hear you on the thoughts about cops sue FFL. Just thinking.

Plus I doubt anybody could argue that you were facilitating a straw purchase when you are selling the collection of a prohibited person. I think you would be fine in this case. I think the case of the FFL who sold to the guy not listed on the invoice and this situation are apples and oranges. But I can understand not wanting to be the one who has to pay to find out.

The way the question, conversation and quantity of firearms. It's not 1 or 2 that it can be a gift ok. Its 23 firearms, all going to 1 person? Made me question it. If you need to sell, and he claimed sell not give them away, then all going to 1 person just didn't jive with me.

I think to start, you should download CADOJ form BOF 110. That form gives you the power to act for your client. Then fill out the form, and ask to speak to whoever handles firearms releases for LAPD.

I did not think that form was needed as a licensed FFL?

I see your concern. But if for some reason I ever had to give mine up I would be selling all mine to Joe. Never planning to though!

We do this with our local departments on occasion. The 5150 has a right to sell his guns for fair market value. We usually get a call from the PD to pick them up.

Generally, the owner of the firearms must facilitate the transaction with the PD first. We then take them in and consign them. (must drive in with FFL and a check)

If the owner has become a prohibited person, then he/she can give power of attorney to a third party (non-prohibited person) and that third party can then legally obtain the firearms and sell them on behalf of the owner.

General Notice of Firearm Prohibition and Power of Attorney for Firearms Relinquishment, Sale or Transfer for Storage (BOF 110)

The third party that has been given power of attorney for firearms relinquishment has 30 days to transfer the firearms.
^They can not legally keep any of the firearms.
^Any firearms not transferred within the 30 day time period, must be surrendered to law enforcement for destruction.

The 2 times I've done transfers from PD (Newark and Pinole) the prohibited person (TRO from ex-wife) initiated the process. In both cases they gave me the contact in the PD who to work with and then I setup a time to do the pickup, pay whatever storage/release fees needed, etc...

In both cases I transferred all the firearms to another person in state. This was because they planned to get the firearms back after the TRO expired years down the road. The PD had no issue with that nor did I. I was very explicit with the person receiving the firearms that the "seller" could not touch, handle, or use the firearms while in their possession. Doing so would make them guilty of committing a crime since they knew they were prohibited.

The 2 counts were about 14 and 6 so not quite 23 and they were explicit it was being given vs sold though.

To pickup from LAPD you need to get an AR number before you can make an appointment. You will also need to have a copy of your FFL and the CA DOJ CFD letter, plus a whole day to spend just picking up the firearms.

The best thing to do is to force the person to do all of the legwork and make sure that you charge a reasonable hourly rate. By reasonable, I mean a lot because it is going to take you a lot of time even after you get the AR number.

Typically there is a detective involved and then there is the officer who deals with firearm releases, and then there is the property room.

I have picked up from LAPD Topanga and once from LAPD Van Nuys. I have been told that all firearms are held in Van Nuys now, but I don't know if it is true or not.

If you pickup from Van Nuys, contact me and I will tell you where to park (don't want to post it in public) or ask the officer in charge of releasing the firearms where to park. They have to walk out with you as you can not touch the firearms until you are out of the building and you don't want to be wandering around Van Nuys with a lot of firearms.

Based on my experience, my suggestion is to use a local place to pick up the firearms and have them sold, it is called Lock, Stock and Barrel in Simi Valley. They auction them for a percentage or they charge an hourly rate to pick them up, but in either case it is easier than dealing with it yourself unless you have a lot of time you want to spend on it.

Oh, you can't get an AR number until you have a notarized letter from the person giving permission to the FFL to pickup the firearms and the letter has to be acceptable, so the person needs to carefully listen to what they want in the letter.
