    CCW/FSC question

    I ordered a 10/22 receiver and my FFL should receive it tomorrow. I have a CCW permit that should exempt me needing a FSC. My permit is valid currently but will expire before the pickup date (I am waiting to receive my renewal from the back logged sac county system).

    My question is will I need to pay and get an FSC or does my CCW exempt me since it is valid at the start of paperwork?

    Personally if it was valid during the initial paperwork it would work for me. If the ffl didn't say anything when you started the dros chances are your still good to go

      The PC says the dealer can not deliver without a valid FSC or exemption. Of course you can not start a DROS without inputing the FSC number or exemption type and falsification on the form is a crime. PC 28250

      Simply put you need a valid FSC or exemption to start and to pick up .


      PC 26840 (a) A dealer shall not deliver a firearm unless the person receiving the firearm presents to the dealer a valid firearm safety certificate, or, in the case of a handgun, an unexpired handgun safety certificate. The firearms dealer shall retain a photocopy of the firearm safety certificate as proof of compliance with this requirement.

      PC 31700 (a) The following persons, properly identified, are exempted from the firearm safety certificate requirement in subdivision (a) of Section 31615:
      (9) Any individual who has a valid concealed weapons permit issued

        I will agree with Bonecutter here, the issue here is the wording DELIVER. I've caught stuff like this before, where somebody had a HSC card and it was set to expire about 20 days after start of the DROS. They were told so long as they pick up before their HSC expires they would be fine, if they didn't they would need to get an FSC or provide us with an exemption. They picked up before the expiration date and it was a non issue.

          Every FFL has and is able to give FSC tests and card right?

          I don't see the issue here. Get your FSC.

            He probably doesn't want to pay the $25 For the FSC. I wouldn't either if I didn't have to. That's a box of ammo, or a REALLY big meal at McDonald's

              Isn't there some sort of grace period on expiring permits? Just in case the new one doesn't arrive before the previous expiration date? And wouldn't it technically still be valid if pickup was done during said grace period?

                  DOJ also seems to be focusing on the "delivery" end of the transactions lately. The latest information bulletin indicating the requirement to obtain a thumbprint on delivery reinforces this. I have always gotten signature and thumbprint on both application and delivery even though it was never really a stated requirement. As far as the expired CCW, I would require the customer to get a FSC if he could present a valid CCW upon delivery.

                    I assume you forgot to include "not" in your sentence :-). If the customer presented a valid CCW, then a FSC would not be required.
