Simple. Say "OK". Then collect your transfer fee and take part of that and send the firearm back since they are trying to make you break the law.

This is exactly what I would do.

Everybody wants to avoid additional taxes. But when someone wants you to be complicit in breaking the tax laws...well, I'd draw that line and make clear where that line is.

If you break the law by yourself that's one thing. If someone else try's to get you to break it...
          Sorry, not sorry.

I would just tell them you are above board and will not skirt tax laws for anyone.

I am not an FFL but I am a business owner. The customer is asking you to break the law. If there are any repercussions it will be on you, not him. You not only will be responsible for the tax payment you could also very well lose your resale card.

If they are asking for a discount equal to the tax, that's one thing.

                Waive the tax?

Tell to try that at Walmart, target, lowes, McDonalds, well you get the idea.

I always ask for a discount, but don't expect them to waive the tax, although many have...

Sometimes customers don't know best. An explanation, although unnecessary, should suffice.

I have customers always trying to skip on taxes. Not here!

This is simple. We have a clause in our customer agreement that says that if says "if any false information given by the customer or any indication that the transaction might not be legitimate will cause the cancellation of the transaction and the customer is liable for any and all expenses related to the transaction, as well as relinquishing all rights and interest in the firearm involved."

So we would not proceed. We require an invoice from the Vendor, or invoice from the seller along with supporting documentation, like a gunbroker auction page.

We had one customer, who I know has been removed from calguns for other shady things, try and tell us he was paying substandard pricing for a popular model rifle, it didn't fly with us. And, this person is no longer welcome to do any transfers here.

To answer you question, we don't need the headache if you don't want to abide by the laws, or in this case sales tax.

No, have them provide you with an invoice that you know is accurate and not fraudulent.

Hey, did you steal that from me?

This is the solution. Asking for illegal things to be done should be expensive.

The other option is to say that if they give you $10k cash, then you will talk about it.

Tell him to sign a note where he promises to put it on his tax return next year.

That does not resolve the CA FFL from being required to submit the money to the CA BOE.
