    Ca pistol purchase frustration

Hello all. Names Mike. I've recently purchased 2 pistols here in CA. Both went to delay status. Ive received my first pistol very little issues after the 30 day wait.
The second purchase (different FFL) also went into a 30 day delay. Now its been 31 going on 32 days. The DOJ stated to me that the DROS has been logged as undetermined with a number entered (don't know what the numbers for but, it seems important). The FFL will not release the pistol because they are waiting for a letter from the DOJ with said number attached. So, i'm in limbo waiting for a letter that may or may not show up.
Is this normal? Am I getting the run around? What are my options now?

        Welcome to CalGuns Mike.

[1]....Is this normal? [2]....Am I getting the run around? [3]....What are my options now?
[1]....This is becoming more common all the time. Millions in fees earmarked for a "Self Supporting" DROS system were skimmed of by DOJ for enforcement rather than doing DROSes. DOJ now whines that they are short handed. A situation they created.

[2]....Yes you are getting a runaround from a Ca Gov Agency. Bureaucrats love sitting on their overpaid bums and jerking citizens around. Go to any DMV for confirmation.

[3]....You're now at the mercy of same bureaucrats. All you can do is wait for them to tire of the game and release your pistol as undetermined. And send the release letter to the FFL.

If per chance your real world name is a common one. Such as Mike "Jones" or "Smith", etc. They may have to sift through hundreds of records of convicted felons and other ner do wells with similar/same names.

Always best to do your homework before buying and SHOP for FFLs that do release on "undetermined". Some are dick head turds and refuse to do so. Even though perfectly legal. Looks as if the ones you dealt with were persons of integrity.

        Good Luck.

OP has already been switched to undermined. I don't think he came here asking why he was delayed.

He specifically wants to know what the seemingly important 'number' is that the latest FFL is claiming they need before they release on undetermined. Apparently, per the FFL, a number that will arrive in a letter.

He wants to know if that is normal FFL/DOJ procedure, or ???

What specifically does it take for a FFL who is willing, to release on undetermined? This is the first I have heard of needing to wait on a letter before releasing to a buyer who goes undetermined.

How common are child support delays? I know a deadbeat dad that is massively in arrears that for long periods does not pay child support but still manages to buy guns in CA with no denials or delays.

At times when he was working or collecting unemployment his wages were/are garnished. So I wonder if enforcement of this is weak and haphazard? Seems like if you pay even a little something you can still pass DROS.

But maybe I'm wrong? I'm wondering if anybody is in arrears but paying if the arrears can affect DROS until paid off? I've always been sort of amazed that CA doesn't check DROS records against deadbeat dad list and force a sale of the guns.

The number the are waiting for is the new NICS number. The old DROS number has expired. It is not included on the electronic letter only hand written on the mailed one. The DOJ only gives us this number for Delays over 30 days.

Thank you. I was skeptical of a physical letter because the DOJ rep stated the undetermined number had beed updated in the system and the FFL needed to call them.
If I read it correctly; you said it would take an additional 30 days to receive this letter with a new NICS number? its been 32 days already since the DROS was entered.

                Thanks again Skyhawk.

The letter typically arrives within 10 days after undetermined. In your day counter it would be between 30-40 days. I've heard of some dealers calling in to get the number too.

I did ask the DOJ about a physical letter. The representative stated that there is no physical letter, anything that is updated is done via electronically.

This friday is the FFL's 30 day of delay notice (which will actually be 35 days after submitting the DROS). I will go down and if they don't release the pistol to me, then I'll take my money back. Then that will be the end of this BS.

Thank you guys for your time and info.

The dealer can call the DES helpline and get the new NICS number. We've had to do it before.

We just call DES and get the number. Usually a customer that has waited 30 days doesn't want to wait an extra 10 for a letter.
