    LGS/FFL consignment situation

    First off I apologize if this is in the wrong section but since it has to do with a FFL I figured I would start here first. I am going to broad stroke this since the situation is still developing and the FFL seems to be trying to fix it but I am still a little concerned.

    Last year I put some items on consignment at a local well reviewed local gun store. The guys there have been really good to me in the past so I had no reservations about putting something on consignment. I figured that it would take the particular items I had on consignment to sell, due to the political climate at the time. However once the election was over and the dust had settled and having not heard anything for a few months I began to look for answers.

    Red flags immediately started to go up.

    1. The shop had moved, which I know happens but when there is stuff still inside the store where it used to be (display cases and some other fixtures), it seemed a little weird.

    2. When I called the number listed during business hours no one would answer and it would go to voicemail, which again I understand because small stores get busy and answering a phone might not be high on the priority list especially when dealing with customers.

    3. I tried showing up at the new location provided, again during business hours, and nothing. I ran into a few other customers in the lot that are apparently going through the same thing I am and there is more than a little discontent for the shop growing.

    I have been able to email the owner and have been getting fast responses but things don't seem to be adding up. I should note that the owner/FFL has informed me that all the items I had on consignment have sold. I am trying to be patient and understanding but at some point, I wonder if there is something else I should be considering. The owner/FFL says he has my paperwork but his old employees did not properly file the sales receipts so he cant cut me a check for the items that were on consignment that sold until he can verify how much they were sold for. I should also note that i never changed the prices on the items I had listed for consignment.

    So my question is, aside from still waiting for an answer and check, are there other things I should be looking in to to potentially recover my money and or items that were on consignment?

    Really nothing an FFL can help you with. Possible criminal, definite civil issue, but you're looking for an attorney, not a FFL.

    Keep in mind that a shop moving may close one location and the other not open for a month or more, but the tale about not knowing what was sold at what price, especially when he can confirm the sale occurred, is fishy.

      Small claims up to 10k . Bring all your records. First registered mail demand letter. Then file. You may be able to file theft charges. What ffl was it?

        Have anything signed from the shop on what items you put on consignment and the price for each?

        This is easy, small claims. Issue 10 day demand letter, after 10 days file.

          Thanks for the input. Unfortunately I don't have any paperwork when I put the actual items in consignment, I was told by the staff at the time that they maintain everything (should have probably walked away at that point). I don't want to call the store out in case the owner is lurking around and delay the process any further.

            No paperwork? Has the owner admitted in email what firearms and sale price? If not get that. Without anything showing what they took you have a uphill battle.

              the owner has admitted that he has found the paperwork when the items were first put on consignment. i will see if they will send me a copy for my records.

                Get him to admit the make model and agreed spin sale price.

                  Ouch, red flag #1. Even with the most honest FFL, things can get lost. Always get a copy of DES Consignment printout, and a written agreement between yourself and the shop.

                  As a small FFL myself, who does consignments, who was overwhelmed by AR15s last year; I can tell you I still owe on dozens of things sold last fall, I just need more time to dig through the stack of papers marked "Oh ****, look at this stuff ASAP!"
