I purchased two guns, a rifle and a handgun from my neighbor who is moving. He gave me a good deal on them because he needed them gone asap. Anyways, The DROS was rejected because the DMV screwed up on my new address (I moved a few months ago). The FFL said we both need to come back and redo the PPT. I already went to the DMV to fix everything so I should be good to go. Problem is my neighbor is gone and I have no contact with him. The FFL says we both have to be present. What are my options here? Any help appreciated. Thank you.

The FFL can talk to the CA DOJ and learn that he can use the original DROS for the seller's signature for the second PPT.Kemasa.

This is what the FFL told me and I confirmed it with the DMV. I was at the DMV on Friday where I got everything squared away and they said my DL is good to go now. I just want to know if I can receive the guns without the seller being present.Comment

I don't know how the ffl would know. All I get is dmv reject. Never has the doj ever told me why. Only reason I ever found out is customer told me. I think the ffl screwed up causing the reject and didn't want to admit it.
Did you actually see the dmv reject notice? Or did you go to dmv because ffl said to?
My theory is that ffl inputted everything with old address. They realized they should have used your new and CA doj told them they had to redo dros because you can't fix that after submitted.
This is my theory because I've done it. I eat the cost as my mistake though. Fortunately hasn't happened on a ppt for me.

Thanks everyone for your input. If what you guys are saying about them trying to cover there own asses due to a mistake is true, I don't wanna make a huge deal about it with them and cause false resentment, they do have my guns. I don't wanna stir up any drama with these guys, I just want my guns and to never go back there again. Can you guys confirm what kemasa said? Not that I don't believe him, I just like hearing it from multiple people before I try and impose it as law with these guys. Thank you.Comment

Well what Kemasa said isn't law per se. Just ask them to validate the info as Kemasa mentioned and call the DOJ. If they are not willing to do that then you are at their mercy regardless of what is or isn't law. If they did deceive you already then expect to follow whatever they ask regardless. You can see something repeated here numerous times, but it really means nothing unless you check with the source. I have asked the CA DOJ about this in the past and that is what I was told, but that means nothing unless you check for yourself. The fact is that they have a signed DROS by the seller. The seller could sign a DROS worksheet and it could be used multiple times should the DROS get rejected.Kemasa.

Alright thanks a ton for the help guys. I'll go over there and talk to them, hopefully they'll be willing to work with me. The handgun is an old S&W 59 that looks like it's never been fired, I would hate to lose it.Last edited by BiggieZ; 12-12-2016, 1:05 PM.Comment

Don't know what it means. Ask them to provide you the DMV Reject letter from the CA DOJ. If they can't, than it means they realized their error.
I don't typically see DOJ responding same day a DROS is submitted. I guess it's possible, but usually I see DMV rejects on day 2 or 3 and it has never ever been address related.
