    Sales Tax Reimbursement for Returned Firearm

    Hi guys,
    So I bought a bullet buttoned rifle last July, from an out-of-state dealer. I paid $100 in sales tax to my local FFL who handled the transfer.

    The rifle is defective, and on its way back to the Manufacturer, it is unlikely they will be able to fix it in my opinion, and due to pending legislation a replacement is not feesable due to the timeline. I'm expecting to hear that they will have to refund my money through the retailer I purchased it from.

    So, the question is- what happens to the tax money I paid to my local FFL? Does it become a $100 windfall for the state? Or is the FFL required to reimburse me?

    I'm aware that the transfer and DROS fees are lost...

    How is the rifle defective? More than likely it'd be a problem with the upper I'd think? Which can be swapped with no problems.

      In some respects you should get a full refund from the manufacturer and let them try to get all of the money back.

      You could talk to the FFL you used to transfer the firearm from and see what they would need to deal with the refund. I have not had to deal with it, but I would think that it would not be too difficult, just an accounting mess.

      The other option is to have the replacement (assuming that the lower has to be replaced) configured to be a featureless rifle.
