Long story short, an FFL is advertising the dros fee as $28.50. Did the fee go up? Is a dealer legally allowed to charge more than the $19+$5+$1 standard fee?

Don't confuse a transfer fee with a DROS fee. A transfer fee is the cost of our service. The DROS fee goes to the state only. On a PPT we can only charge 10.00 per gun for the transfer. The state DROS fee is still only 25.00

They cannot add a dealer fee beyond $10 per firearm for PPT. They can collect fees for FSC, but they can't make up their own fees in a PPT.

28055. (a) For a sale, loan, or transfer conducted pursuant to this
chapter, the purchaser or transferee or person being loaned the
firearm may be required by the dealer to pay a fee not to exceed ten
dollars ($10) per firearm.
(b) No other fee may be charged by the dealer for a sale, loan, or
transfer of a firearm conducted pursuant to this chapter, except for
the applicable fees that may be charged pursuant to Sections 23690
and 28300 and Article 3 (commencing with Section 28200) of Chapter 6
and forwarded to the Department of Justice, and the fees set forth in
Section 31650.
(c) The dealer may not charge any additional fees.
(d) Nothing in these provisions shall prevent a dealer from
charging a smaller fee.

And remember a PPT is ONLY a face to face in person transfer between the two private parties at the dealers place of business. When you buy from an out of state individual it's a regular transfer and a dealer can then charge whatever he wants for his fee.

OP didn't say anything about PPT, I assumed he was running into something like the Turner's Dealer Fee... $5 on a new gun I think?They cannot add a dealer fee beyond $10 per firearm for PPT. They can collect fees for FSC, but they can't make up their own fees in a PPT.

Ya... they're correct on the PPT fee, but DROS is $25, unless they break it out as a separate $3.50 on the receipt.- Rich

OUT THE FFL!!!! JK. Sorry still reeling from the thread about me in the centerfire forum. As said it's probably misguided intentions. Educate them and show them the above mentioned PC about this. Also, just a thought. Maybe the 3.50 is for a lock? Not sure. Just ask and help educate. Duh he is only charging $28.50 instead of $35 he could have charged . The dealer fee is for buying his firearms not dros.Comment
