    5 pistol sales a year

    Hi guys, this ridiculous limit still stands right? This might be a dumb question, but, I've traded 2 pistols for other pistols this year.......these count against the 5 correct? Thanks in advance guys.

    P.S.
    I'm sure this has been asked before, but I used the search function and found nothing, so I'm asking again.

      As a regular non FFL holder. I'm sure FFLs are unlimited.

        you mean pistols you manufactured, without being a manufacturer?

        Or like, you bought the pistol, now you are going to sell it?

          Trades count as one transaction.

          DOJ knows a transaction has occurred (DROS), they don't know whether money has exchanged hands on a PPT as a sale or trade.

            I did not know that.

            So, what do people do with inheritances of collections? A guy that collected 100 pistols, his family takes 20 years to sell them?

              You can sell all 100 of those pistols as one "transaction" to a single buyer.

                  got it. Thanks. So what happens when a guy goes in to do his 6th or 7th transaction? Does it get rejected or something?

                    Probably not. It just raises a red flag with the Authorities and they might open an investigation on you.

                      This has been raised here a few times.

                      Many CGers have done more than 5 with no problems, but it is against the RULES!

                      IIRC, no "regular citizen" has been prosecuted for this.
                      They are trying to prevent someone from having an unlicensed gun business.
                      (Gotta collect the taxes and fees!)

                      There is an exception of some kind for inheritance sales.
                      One of our legal folks may show the PC in a later post.

                      Otherwise, plan ahead as best you can to avoid getting on another "list".

                        Excellent post from the Nun above. The exception for disposing of inherited firearms is contained in Penal Code section 26515. Here is the text:

                        "Section 26500 (which requires a license for the sales of firearms) does not apply to the sale, lease, or transfer of a firearm if both of the following conditions are satisfied:

                        (a) The sale, lease, or transfer is made by a person who obtains title to the firearm by intestate succession or bequest, or as a surviving spouse pursuant to Chapter 1 (commencing with Section 13500) of Part 2 of Division 8 of the Probate Code.

                        (b) The person disposes of the firearm within 60 days of receipt of the firearm."

                            Buying is not an issue, selling is, especially buying and then selling. Selling a collection does not seem to be an issue.
