    FFL exemption

    To make it short, can a FFL dealer go to a gun store, like Turners, and purchase a handgun for personal use, and have the 10 day wait period waived?
    If not, can a FFL dealer go to a gun store and buy a handgun for his inventory and have the 10 day wait period waived?

    If you have access to your inventory I don't know how a wait would affect you.

        Are you buying inventory or firearms for personal use?

        Inventory doesnt require a waiting period.

        BTW - Good luck getting approved for a home based FFL to bypass Kalifornistan asinine laws....

          Yes, depending how his FFL is set up.

          Yes, but if it's for his inventory it doesn't get DROSd. It's a transfer and the place he is purchasing will need to provide a Firearm Shipment Approval number as well.

            You need to have a CFD number and access to the DROS system. If you are an exempt FFL meaning you do not perform DROSes your state license number is different and will not work for the 10 day exemption.

              Can you expand on this? I'm not aware of any exception for FFL's to not DROSing a firearm for personal use.

                If the person has a CFD number, then they are exempt from the 10 day waiting period, regardless of how the FFL is setup. The DROS has to be submitted. If the FFL is a sole proprietor, then no 4473 is required.

                If the person has a FFL, in theory, they can go to another FFL and immediately pickup the firearm for inventory with all the required paperwork (FFL, CFLC, etc.).

                The problem is that some FFLs won't honor the FFL and/or how they work means that they don't honor the no waiting period. For example. Turner's often has the firearm in their warehouse, not in the store, so it takes some time to get it to the store.

                  Huh? A DROS is always required. A CFD is an exemption to the waiting period.

                    OCArmory was saying if you're a gunsmith (exempt FFL from using DROS system) then bypass 10 day wait wouldn't apply to you. May have just been worded weird, but that's what I assume he meant.

                      Yes if you are an FFL that does no have access to the DROS system you have a different number then the CFD #. It is not recognized for the 10 wait exemption.

                        I have personally done both methods.

                        Big 5 was having a sale on mossberg 500s and my dad wanted one so I went with him and did a dealer transfer to my inventory. They did a shipment approval from them to me, marked it in their books, and I marked it in my books. I then performed the dros for my father and he waited 10 days.

                        Big 5 had a special edition savage Mark II that I wanted, I went in have them all the paperwork and my cfd# and they performed a dros to me personally and waived the 10 day exemption using my CFD #. I walked out with my gun.

                        My FFL is set up to me personally as a sole proprietor.

                        I'd imagine if it was set up as a corporation it'd be a different story unless the CFD # is issues to the individual rather than the corporation.

                          CFD # is to the individual not the corporation. I have done the same thing as about. Go to big five sale and walk out with the firearm. I would not expect most retail store employees to be able to do this though.
