    FFL purchase USED gun for resale

    Can I get directed to a thread describing USED gun purchase by FFL from private party for resale. Specifically, does FFL have to DROS gun to himself if it is off roster before he can resell it? If it is on roster can FFL just A&D it then resell it? Handgun and long gun specifics. Thanks

      Also do you have a second hand dealers license. In general the firearm must be taken into your A&D book which would make it a dealer sale. Consignment being the exemption. This becomes somewhat muddy when the ffl is in the individuals name and not a business name. I probably would not look for a thread on legal advice but go directly to the doj. On my iPad now but I will post the links to the doj website later regarding second hand resale.

        Are you buying the gun as a PPT for you or to resell?

        If it is for you then just do a PPT lik normal, if the FFL is in your name then use your CFD to make it 10 day wait exempt.

        If this is a gun you want to buy from someone to resell you need a second hand dealers license, enter it into the acquisition system, wait 30 days before DROS can be completed (DROS can be started on day 20) and you need to charge sales tax.

          And, if I'm not mistaken, (seems to me I read it somewhere) you must keep the gun for 1 year before selling it??

            I'll buy PPT in my store, FFL in my name. If I PPT to myself, can I resell it?

              Yes, just like you can re-sell anything in your collection. However, don't do this method for your store inventory. If you PPT to yourself that implies you want the firearm for you and not your FFL inventory.

                If you are buying it to resell and the firearm is not on the roster, then it would need to be a consignment sale. A FFL can not buy a non-roster firearm for resale unless it is only sold to someone who is exempt.

                It is possible, although there could be some issues, to transfer to yourself as a PPT and then later sell it PPT. There could be issues if you don't have a secondhand dealer permit, as well as getting around the 30 day wait for consignment sales.

                There is a form that you have to fill out for consignments, as well as waiting 30 days before it can leave.

                No. If the FFL is a sole propriertor and transferred the firearm to their personal collection without filling out a 4473, then if they decide to sell it within a year they have to run it through their business.

                    Does the FFL have to fill out a 4473 since we are licensed and not un licensed? i just did a PPT to myself from my father as its about 9 weeks faster than op law form at the moment but i can't remember if we are suppose to fill out a 4473 or just do a dros. I logged it into my book coming from him and out to me with name and license number.

                        Ok that's what I thought but wanted to double check. Since I am a sole proprietor I just log out as personal inventory.

                            No, you don't fill out a 4473 IF you are a sole proprietor. Your bound book should be marked that it is for the owner's personal collection.

                            The intrafamilial transfer is faster and cheaper even if the paperwork takes longer. Unless you are planning on selling it right away, what difference does it make how long the paperwork takes?

                              That is a good question and I don't know the real answer, but it seems like the main issue is in regards to buying and selling, not just selling. Also, it is transactions, not firearms. 100 handguns sold at one time is one transaction.
