    Can I cash and carry M1 inside CA?

    Two M1's are ready for me at MilTech. I have an FFL-03 + COE. He normally ships them out and leaves the paperwork to the recipient.

    Can I pick them up from him without him having to do any paperwork? What paperwork do I need to file?

    If they are "my" guns you already own them. Just pick them up. If they are still his guns that you are buying he'll have to log them out of his book and deliver them to you. You'll have to do the paperwork for the DOJ.

      They are his that I am buying. When you say "deliver," do you mean ship, or hand to me!

        My understanding is that with C&R, if you do have the 03 and then COE, cash and carry is fine, but you'll have to fill out the form and mail in your extortion fee to the state.

        Of course if I'm wrong, I'm sure someone will be along to correct me.

          With a 03FFL and COE, you still have to complete the DROS and 4473, but for C&R firearms, are exempt from the 10 day waiting period, and on C&R handguns, the 1/30 day restriction. The real question is whether the work that Miltech has done disqualifies the firearms from being considered C&R.

            Does Miletech complete the DROS and 4473 or do I? He believes that he doesn't need to do any paperwork.

              As a licensee, you don't have to fill out the 4473. You are only a licensee with respect to C&R firearms when you have a C&R FFL.

              The laws get confusing and changes make it more difficult. I checked with the CA DOJ, which does not really mean much, but they said that with the changes that long gun serial numbers have to be submitted on the DROS, no C&R long guns can be shipped to a C&R FFL holder directly and the FFL has to submit the DROS for pickup. This answer may or may not be correct, but it is a safe answer :-).
