Bullet button issue during 10 day wait

Ok here is my issue. I have sold a gun by PPT and the soon to be new owner just contacted me and said there was an issue with the bullet button. It is Saiga 12 with a Raddlock. The dealer said that the Mag can be released if you press hard with your finger. I never tried so I can not confirm. I always used the tool. Not sure if we could just throw on a clamp on BB to meet compliance if this is a concern with the transferring FFL. The FFL doesn't know what to do and is now contacting the DOJ. Can the gun be transferred to an FFL07? Can it be returned to me and corrected and re DROSed?The FFL in possession is an FFL01 not an FFL07.

If the firearm has what would be considered a detachable magazine and features which would make it be considered a so-called a-salt weapon, there are two solutions. The first is to ship it back to where it came and the second is to turn it over to the police. Since it is a PPT, that is an issue. Cancelling the DROS and returning it to the buyer might work, but due to Federal law, there needs to be a background check on that person within 30 days, which would not have occurred.

No one in CA can convert a so-called a-salt weapon into a non-so-called a-salt weapon. There was a bulletin about this.

The bottom line is that you might be SOL. Unless something is loose and can be tightened to solve the problem, but even that might be questionable. If the FFL contacts the CA DOJ, the options can get far more limiting.

1...The purpose of this notice is to advise California Firearms Dealers (CFD) that the possession of ANY dangerous weapon, without a Dangerous Weapons
License/Permit(s) (DWP) issued by the Department of Justice ‐ Bureau of
Firearms, is prohibited. Such possession may result in criminal charges and arrest.

 There is no DWP condition that authorizes CFDs to convert assault weapons
into California compliant firearms for the purpose of sales. Such action may
result in the revocation of your DWP.

2...If the characteristics that make my firearm a category 3 assault weapon are removed, can I cancel the registration? Can I sell it as regular (non-assault weapon) firearm?
      ..........
Yes. If the defining characteristics establishing a firearm as a category 3 assault weapon are removed, it is no longer an assault weapon and the registration may be canceled. However, once the registration is canceled, you can never replace the characteristic(s) that make it an assault weapon, or you will be in possession of an illegal weapon. To cancel an assault weapon registration, contact DOJ at (916) 227-2153. Once the registration has been canceled, the firearm can be sold or transferred like any other firearm (non-assault weapon).

Why not just tell the FFL to quit being an idiot and to either take a small flat head and turn the screw so that the raddlock won't be pressed.. Or to let you go in and do it

Is there a date and a DOJ/Firearms identifier for this memo? It's helpful to point folks to the source.

I've never been able to release a magazine from a Saiga 12 with a Raddlock installed correctly.

Are you sure it is a FACTORY Raddlock and not the knockoffs floating around?

If the FFL called the DOJ then his hands are tied on what he has to do.

If you sold it via PPT how is the dealer now having an issue after the process is done? Is it still in 10 day lockup? Was it discovered during pickup? Was it discovered after pickup and buyer brought it back to FFL asking for it to be fixed?

Issue with this is that now you converted an ***'ault weapon to a non ***'ault weapon.

It was posted on the DES, but there is no real info other than the text. Normally it is done as a memo with the full info, but this does does not.

They do reference the following Code sections:
